Another ebay query....

Hello everyone, I'm just looking for some advice

I bought an item on ebay but the listing was removed after I paid for the item. You cannot look at the listing any more because it's been removed. I contacted the seller to ask whether he had sent the item out already and (not surprisingly) he had. It was a pair of headphones. Now I have received them and they are (in my opinion) fakes, which was the reason the listing was removed I suspect.

As the listing was removed ebay say that having received it I have the option of returning the item. It is also in my opinion SNAD as the listing said it was boxed etc, but it wasn't. What I am wondering is, am I liable for return postage in this situation, and also do I have to prove that the seller receives the item back, ie. special delivery in order to get my money back. I just don't want to be out of pocket over an item, that's all.

I don't know whether to ask for a refund based on the fact that the item is SNAD, or simply because I have the right not to accept it due to the listing being pulled, which I thought might be less confrontational.

Incidentally, as the listing has been pulled I cannot leave him any feedback.

for the sake of hassle, buyers tend to just say not received makes life easier obviously not good for the seller but serves him/her right for trying to pull a fast one with the fakes

may not be of help but .. i got done by an ebay seller who pulled the item and then disappeared!!!
anyway...
just start a paypal claim (not ebay claim) if his paypal account is active then it may work, and you should still have the ebay confirmation emails of the sale and paypal payments confirmation email, take photos of the item to show they are fake etc... and follow through with the claim
dont return the item - he's not to be trusted - if he communicates with you - tell him to refund all of the money first before you return.
or ask for a partial refund paypal asks how much you want back... so set it a little less than the full amount - if he agrees he will refund. then if he asks for the item to be sent back then you are in control, ask for a further payment to cover postage back, if he pays send it if he doesnt - dont.
if he doesnt communicate - paypal should refund you in the end

File with paypal resolution (ebay are a waste of time) when they find in your favour and say return for refund point out its a criminal offence to mail counterfeit items.

@ sedd33 Yeah I do see what you mean.....not sure I like the idea of lying though and would rather sort it out properly if I can. Thanks though.

But the buyer has received and ebay know that.

Send the seller a message stating everything that is wrong with them and ask for a refund. If they decline then open a dispute with paypal.

Return them either recorded or special delivery depending on how much they cost, you need to have proof that the seller receives them back. A decent seller would refund the postage but they don't sound very decent to me.

I would also post the username on the ebay community so that others know.

in that case, be prepared-

1- paypal will ask you to return the item
2- paypal will not issue refund if you cannot proof of delivery/signature with door no+postcode on postal receipt- so only way to send it is special delivery which is costly
3- the seller can refuse to sign for the parcel thus your parcel will be returned which means missing paypals 10 day return confirmation deadline
4- refunds only issued if seller confirms that the goods were returned in original condition

You can't return them if they are fakes. It's against the law.

Just one more thing, does anyone know if I would I have to prove they are fake, like getting some sort of paperwork, in order to get my money back that way? I could offer pics of genuine vs counterfeit but I don't know if they would accept that.

if its been removed then put in claim for what it is....snad

more thn likely you will get pretty much instant refund if it hs been removed by ebay s they will be aware of the seller

sedd is giving bad advice, 2 rights dont make a wrong regrdless..... and claiming something hsnt turned up when it actually has is fraud/theft/deception and not advisable advice for a public shopping forum
