Another one for Dino me thinks... 'redelivery' on an ebay item? whos responsible?

Well I am normally a person who can give very good advice on all things ebay - but when it comes to my own problems.... not a chance

I bought a computer costing over £444.50 with delivery, it was being built from scratch so I allowed some time for them to send it. 4 weeks to be exact.

At this point I'd like to add I checked the feedback first and the only hang up was slow delivery, hence why I waited so long. They also had an online store and are a registered company, so I thought my money was in safe hands.

I emailed them 2 days ago to ask when I can expect the delivery, to which they replied that the 'PC went out as normal after you paid and got returned back to *company name*, you need to e-mail support to resolve this issue and get it sent back out etc'.

So I emailed support saying that I had never received a delivery, that I had no notification of delivery, and no one contacted me to tell me that it had been returned, and could they please contact me as soon as possible to resolve this.

I received an email this morning in which they tell me that ANC tried to deliver it, returned it, and I must pay for redelivery (which is £34.50).

Well I have a few issues with this. How do I know they sent it in the first place and they arent trying to scam me for more money? There is someone in my house EVERY day so theres no chance I missed a delivery. Why wasnt I notified before it was returned if it was supposed to be by a proper delivery service? Why wasnt it re-delivered, if it was ever sent? The list goes on!

In my mind I have paid my money and they have a contract with the delivery agency - not me. I have no proof that they even sent it out in the first place, and to top that they told me today tht they recieved it back at the end of last month. Well if that was the case, why didnt they contact me in the last 2 weeks to tell me my £400 computer is sitting in their warehouse?:x

All things presented I'm not sure I can believe their story about delivering it.

I paid through Paypal on my credit card - luckily!

What would you do?
Where do I stand?
Should I pay for re-delivery?

And help with this one much appreciated! When it happens to you, your mind goes blank!

I would not pay. Part of your contract with them is to have the item delivered to you. If ANC have failed to to that, then they should take it up with ANC and not expect you to pay for it to be re delivered.

The seller is responsible for delivery. It's their problem, not yours. I'd threaten them with a PayPal dispute/legal action if they don't deliver it within the next 7 days. If they don't, file a dispute with paypal.

Nope no card, no phone call, nothing - not even a computer lol

I won it on an auction - not a buy it now - so its seeming to me like they didnt want it to go at that price and that they just didnt post it. I feel like this is a way of getting just that bit extra out of me.

Ask for the courier tracking number - verify it with ANC. If they haven't sent at all it should be evident.
If they have all they'll do is give that number to paypal and you may or may not win a dispute. If they don't provide one you know they didn't send it.

I would file against them, they should have proof of posting for the computer. Ask to see it.

What if they did send it with ANC? And its ANC's fault it wasnt delivered and I've had no communication? Where do I stand then with Paypal? But if I lose, I still have no comp. Would I have to claim it from my credit card company?

I should know one way or the other in the morning as I've asked for proof.

As others have mentioned, none of this is your fault so you should not be paying either way.

If the seller can provide proof that they sent the item correctly and it's the delivery company that's at fault then the seller needs to resend it at their cost and resolve it with the delivery company. I think if you do get a tracking code however, I'd contact the company and try to find out why it wasn't delivered.

On the other hand if the seller can't provide any reasonable proof then it may be the case that they never sent it in the first place - if they refuse to send it out to you without additional payment I would log a dispute although there's no guarantee these days sadly that Paypal will rule in your favour.

Overall be careful with deadlines, as you only have 45 days to claim back from Paypal which it sounds like you're not too far from.

Hopefully you can get it sorted ok without have to resort to any of that,

that would be the last place i would look to buy a custom built one

only cause i can do it myself:giggle:

shoulda called me i woulda built it and got it to u within a week lol

It's possible they tried to deliver it to the wrong address, that would explain why there was no card left through your door. Either way, get the tracking number from them as others have said, to see if you can work out what happened & obviously if they don't provide one they are trying to scam a little extra out of you!

Paid 16th April, Recieved finally.... today.

Only after opening a dispute through Paypal though - thanks Dino!!!!! They said they would send it back out at their expense, so I asked for a tracking number. 5 days later they still hadnt provided one so I politely told them that if there was no more contact within 24 hours I would escalate the claim. Yesterday I received the tracking number and low and behold they had put it on a next day delivery service - 5 days after agreeing to post it!

All I have to do now is put on operating system on it, and hope that everything I paid for is there....

Hmm will the saga continue?.....

I hope it is as described.. paypal is a pain for changing dispute type from Not Recieved to Not as Descibred. Alot of ebayer sellers pull it- don't send, wait for claim, apologise n send by next day, but just post rocks/sand or whatever to equal weight. Withdraw cash, close ebay and paypal account. Start over.

I have a progamme called Aida that will give me a break down of all the components so I'll be checking that this morning! The only obvious thing I noticed when I opened the back up is that I paid fr a 500mb hard drive and got 2 x 250mb hard drives. Not entirely certain how this wlil affect it, will soon see though...

Start over.

To be honest, I've never heard of anybody successfully opening another Paypal dispute once you have closed one. This is where the Credit Card Company would come in handy.
This seller is notorious for offering 'add ons' after the auction. I bought from them about 3 years ago.

I havent actually closed the dispute yet.
They asked me to close it before it was even posted but I said that it would only be closed when the computer had arrived and I had checked to make sure that I received everything that I had paid for.

XP is oading as I type - so fingers crossed there wll be no need to go back through Paypal or my credit card :w00t:

I've had stuff "delivered" using ANC where they never bothered their backside to try and deliver it. I had an argument with a manager on the phone who was telling me that the delivery driver left it with a neighbour in the house ajoined to mine. I asked him if he was sure and he said he was positive. I then informed him that my house wasn't ajoined to any other building and there was gardens all around it. After 1 minute he came back on the phone and apologised and told me it never left the warehouse.

By the way, the responsibility of re-delivery lies with the sender, even if you have paid for it as they entered in to a contract with the delivery company to deliver the item - unless you have ignored reminders or not collected the item from the depot.

Parceline is just as bad. I waited 2 weeks for my router after sky said they had sent it and they eventually gave me the tracking number which stated they had left a card FOUR times. I never received a single card.
