My sister bought a TV (32" Grundig) from cash generator (a cex/cash converters type shop) for £300

The TV is faulty so I took it back for her today and asked for a refund, the guy said he would check it for faults and as long as it's faulty he will call me by the end of the day to sort it out.

He rings me back to say he agrees it's faulty and they will repair it and it should be ready by Friday!

I say no, its ok I'll just have a refund.

He says we don't do refunds as all the items we sell are graded.

I say I'm on my way.

He says we are closed, come in tomorrow but you won't get a refund.

Anyone know the legal stance on this and care to comment?

She bought the TV a week ago and paid cash.

No it wasn't. It was apparently "Graded" although looking around the shop it probably wasn't marked up as such.

I've not been in a CEX/cash converters.. I dunno what "graded" is?

Ah the Cash Generator scammers lol, what store was it if you dont mind me asking?

I doubt they are right though as they seem to bend laws and rules so that they never refund as I know someone who bought a £600 pc from them about 6 years ago that ended up to be stolen and they gave the buyers name and address and the person lost their newly bought PC and never got their £600 back.

Basically second hand but polished up.

Can you get hold of their policies? Does it say goods are sold as seen and non returnable?

SGAct says the goods should be fit for their purpose, your sister's tv isnt. What's he doing selling faulty goods anyway?

Pop into the police station and say you think there may be some trouble if you go into the store alone?

I am going to give them a call tomorrow, I just thought it worth asking if anyone could enlighten me or had a similar experience. I never would have let her buy it from there had I known, it wasn't even like it was cheap:?

10. OUR REFUNDS POLICY
10.1 When you return a Product to us:

10.1.1 because you have cancelled the Contract between us within the seven-day cooling-off period (see clause 6 above), we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Product in full, including the cost of sending the item to you unless the delivery charge also included other Products which have not been cancelled. However, you will be responsible for the cost of returning the item to us;

10.1.2 for any other reason (for instance, because have notified us in accordance with clause 20 that you do not agree to any change in these terms and conditions or in any of our policies, or because you claim that the Product is defective), we will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund for the defective Product. Products returned by you because of a defect will be refunded in full. If you notified us within seven days of receipt that the Products were defective and subject to us confirming this, we shall refund the cost of sending the item to you unless the delivery charge also included other Products which have not been cancelled and the cost of returning the Product to us by normal post. If you inform us of the defect after seven days, you will only be refunded delivery charges and the cost of returning the item to us at our discretionWe will usually arrange to refund any money received from you using the same method originally used by you to pay for your purchase.

10.2 for any other reason (for instance, because have notified us in accordance with clause 20 that you do not agree to any change in these terms and conditions or in any of our policies, or because you claim that the Product is defective), we will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. Like any second hand shop they often charge around new price but if you sell the item to them they give you like 5-10 times less than its value I remember buying GTA Vice City when it was released for £25 used, taking it back 2 days later as was skint and offered £1.80 for it! and when I bought a 32" tv for £180 from Cash Generator I moved house 2 months later so about a week before I moved took the tv in and was told it was in bad condition and offered £10 for it despite them selling a 28" model the same and without a remote for £150!

No, it doesn't.

The receipt says "Buy with confidence" :w00t:

You're right though, there will be trouble, but I will be the one making it and if anyone is calling the police it will have to be them:)

Thanks but that will be their web policy, the store policy will be different as distance selling regs won't apply.

My local Cash Convertors had 69p dvds in before and 3 for the price of 2 so that was cheap!

These sort of companies though prey on poor and needy people, I took a £50 pair of speakers days old before into one and was offered £1 because their words "they are just normal pc speakers which we have loads of" and took a CRT monitor in about 5 years ago back when they were like £100 new and was offered 50p!
