So I bought my gen 4 ipad retina from apple as a refurbished product back in 2013. Battery has not been keeping charge recently so rang apple to find out how much a fix was. They quoted £276 for a full hardware fix!!!

But then the nice man said you might be eligible for a consumer law replacement if you get the hardware fault diagnosed at an apple store (free) or authorised service centre (charge which is refundable). He gave me a case number, i took it into a centre, paid £36 and three days later I got a shiny new like for like replacement. Even better, I'll get the £36 back.

Worst case scenario you've only lost £36 if there is no fault and you haven't tried the usual DFU restore processes.

To clarify, I don't have any applecare protection. Just the 1 yr warranty which expired ages ago

Consumer Rights Act 2015 If you are outside the 30-day right to reject, you have to give the retailer one opportunity to repair or replace any goods or digital content which are of unsatisfactory quality, unfit for purpose or not as described.

You can ask the retailer to repair or replace faulty goods but it can normally choose whichever would be cheapest or easier for it to do.

If the attempt at a repair or replacement is unsuccessful, you can then claim a refund or a price reduction if you wish to keep the product.

You're entitled to a full or partial refund instead of a repair or replacement if any of the following are true:

the cost of the repair or replacement is disproportionate to the value of the goods or digital content
a repair or replacement is impossible
a repair or replacement would cause you significant inconvenience
the repair would take an unreasonably long amount of time
If a repair or replacement is not possible, or the attempt at repair fails, or the first replacement also turns out to be defective, you have a further right to receive a refund of up to 100% of the price you paid or to reject the goods for a full refund.

If you don't want a refund and still want your product repaired or replaced, you have the right to request the retailer makes further attempts at a repair or replacement.

Would this apply to the recent Note 7 recall issue, Samsung have limited the battery and issued a world wide recall due to the 'explosions'. I have waited over 2 weeks for a replacement and I am still being told there is no eta for safe devices to arrive.

Can't see why this can't be applied to any goods of sale in the UK. It should state in the terms and conditions of sale about consumer rights as Apple does.

Apple are the ONLY retailer in the UK that takes the Consumer Rights Act seriously. Any item purchased from them that develops a fault within six is replaced without any fuss whatsoever. Every other retailer big and small, you'd have to fight tooth and nail to get anything done. I am just trying to get Logitech to replace one of their so-called Ultimate remote. They are a joke of company. Samsung are a joke as well.

Apple are one step ahead on this, most other companies would if you pushed them on the law, after telling you 10 times it doesn't exist make you pay for an expert to do the analysis. But the problem there is that their expert knows more than your expert so you end up running in circles.

That's not a hardware fault so rightly so. That wouldn't be covered by consumer law.
