Argos Advice Please.

Bought my dad an Archos from Argos in May for his 50th. Bought the insurance cover too.

It's now not charging when he plugs it in. I asked in a cornwall store whether he would be entitled to money back and was told if it's within 12 months he is entitled to it. Wondering if that's true or whether they were just telling me that to keep me quiet!

Have got insurance on it, but I think dad would prefer the cash now.

Would be interested in people with experience of this rather than just opinions please.

Many thanks.

He is entitled to REPAIR or REPLACEMENT.

Not a refund, unless the other two options are not available.

It's probably the charger that's faulty anyway.

Have I got this right, you've asked in the store and got your answer.
But you don't believe them and are now asking a bunch of strangers?

Wow.

I would also ask for a 2nd opinion, As we all know that these Retailers will try & Flob you off.

With many small electrical items like this or mobiles if they dont have the same thing in stock Argos will often give you a refund,,

I found this on the website (I need to return a notebook bought in Apr)

''If you've had the product for up to 1 year, we'll repair the product or, if that's not possible, give you a replacement or, if that's not possible, a refund.''

http://www.argos.co.uk/static/StaticDisplay/includeName/ReturnsAndRefunds.htm

Argos told me I couldnt have a refund or replacement, it would have to be sent away for repair, which would take approx 6 wks.. Id rather have a replacement though, Im too impatient.. 6wks without t'internet :(

But surely you got the answer you wanted - they offered you a refund in the Cornwall shop - that's what you want - why are you asking for advice ? Just take the money:thinking:

Op why would they say this to you just to keep you quiet ? did you threaten them with watchdog & ts

Just to update.. and prob make things even more confusing! I just rang Argos C/S again to double check as Id rather have a replacement instead of sending away, she said the store it was purchased at would send it away but to give the specific store a call and check for their up-to-date repair times..
I called the store it was purchased in, he told me I needed to ring Samsung before coming into the store, if Samsung said they wouldnt be able to repair it, then they would look at a replacement..
So I then called Samsung, they think its a display fault and are sending someone out in the next few days to repair it, they should repair it and have it back with me within 5 days..

No wonder OP asking, Argos seem to tell you all sorts!

But if they're offering you the money, take it! I wish they'd offer it me!

So OP

You want a refund

You asked Argos if you could have one

They said yes

Now you are confused?

Why not go take a long lie down in a darkened corner and see if that helps?

Remember folk, your contract is with the store. NOT the manufacturer, so the Manufacturer's guarantee is in ADDITION to your legal entitlement.

When you are sold new goods, you and the seller enter into a contract that the goods are as described, reasonably durable and without defect.

If they ain't, the seller is in breach of his contract and has to do something about it.

Up to 6 months (I think) you can demand a refund. that's refund, not credit note. Longer than this and you may have to accept a repair.

There isn't any specific ti,e limit, other than that the goods must be reasonably durable.

In Law, I believe the only thing which does limit what you can claim is that you can't go back more than six years.

So, your legal expectation is that you can get a repair up to 6 years, if it would be reasonable to expect the item to last at least that long.

You may have a fight on your hands if it has been a long while, but 8 months should be easy.

These may be useful:

how do these people exist?

errrr ok...

just to make it simple for you..the ones who cant seem to follow the thread but are calling us thick..

My experience:
1 SAMSUNG note book purchased from argos. Doesnt work properly anymore.
2 telephone calls to Argos C/S. Instructed to call the store the note book was purchased at.
1 telephone to the manager of Argos store the note book was purchased at. Advice given to call the tech ppl at Samsung first. They would then advise on whether it was repairable, if not, then go to the store and talk about replacement or refund.
1 telephone call to Samsung, advice given: tech guy to come out, look at it, and take it away with view to repair.

So I call Argos before driving miles to the store, I follow their advice re returns/faulty products and yet I'm stupid?

We also bought a 50 inch Samsung TV from Currys last yr, when that wasn't working we had to do the same thing then. We called currys first and followed their advice re calling Samsung tech guys... Maybe it would've been better to strap the tv to the roof, drive to comet and have them tell us we had to get the manufacturer to look at it before getting a refund etc.
We also bought a microwave oven from them, that stopped working. However they let us exchange it for another one (diff make/model as the other was no longer in stock).

The comments were directed at the OP, not you I believe

I must say some of the threads on here lately are just people failing to use any common sense.

Someone just started a new tesco one saying they bought a hard drive in May and its now broken and can they take it back. :w00t:

I kid you not! :-D

You bought it from CURRYS, but thought it would of been better to return it to COMET?
