Asda shoping delivery dilema

hey guys

After some advice on a problem or dilema i have,i ordered shoping through the asda website and aranged delivery for between 7pm and 9pm on the 25th november,on the day this time came and went and no shopping,i waited up until 10pm no shopping so decided to call the call centre which closes at 10pm(was unawre of this),having to get up at 5am for work the next day,i went to bed.
About 11.40pm the phone rung,woke me my wife up,it was asda delivery guy saying he was outside with my shopping,i asked him where he had been and he said he was busy that day......i wasnt happy with the time he arrived,but as me and my wife both work we both got up to get the shopping in,by this time all 3 of my young kids were awake.
I answered the guy to the guy,no appology from him or anything,he brings the first two bags in then,he comes with a load of the green delivery trays on his trolley,as he is coming down the patio i could see liquid running from the trays,a bottle of cider my wife ordered was burst and was allover everything.
i was furious and that time of night and everything covered in cider,so i refused the entire delivery,and told the driver to take it away.
i phoned my local asda the next day where the delivery originates from,spoke to the home delivery manager who appologised and said he would repick my order and deliver in the afternoon,he also said he would speak to store manager about some form of compensation/goodwill gesture for me.
The order arrived,with the original delivery note from the day before the guy said just to sign my name on a bit of paper and off he went.
while unpacking the order there was at least 25-30 items missing,and most of the rest of it smelt like cider.so not repicked just the worst of it fished out and then redelivered.
called the store again spoke to manager again,told him the situation,he said he would refund missing items (which never happened),i asked him about my compensation he said would be credited to my account in the form of an evoucher,he said he couldnt recall telling me this....again furious and the rest of my shopping smelling of cider,the guy said he would call back,but in the meantime he would credit my account with free delivery next time and a £20 evoucher neither of which have happened yet.

Now for my dilema,as i refused the original order the bill for the shopping got refunded to my bank account,and my online account at asda.com shows the order as canceeled,no new order for the stuff i got delivered and nothing charged.
wife told me yesterday when i came in from work asda accounts dept on the phone for me looking to confirm my payment details,i presume for the re deliverey as i know they cant just charge me for this with out my say so.
where do i stand legaly with all thats happened to me and everything they said they would do but havent.

any advice would be great,as i plan to call them today

im still waiting for my compensation btw
i would tell them you're not paying as you did not ask for gods in the condition they are in and to come and collect them!
that is worse than disgusting cs but i dont expect more from asda!
i would also contact trading standards to report and watchdog as i believe they are looking at asdas trading!!

i wud tell them to jog on, however don't think that wud wash from a legal point of view :)
i agree with the plumber though, although signed for goods to accept reciept, when checked not in a satisfactory condition and if they want them back complete with cider stench they can come and collect them.

I would go straight to ASDA, got tons of refunds out of them because there service is crap. Only shop instore with them now and when they give me discounts over £10 online. They get it wrong everytime i've shopped then and give you excuses.

Switched to Tesco's and I was an avid tesco's hater.

They were on hour late the other day because of the weather and orders I complained expecting to get the delivery back and they said fine, the other day I got an email saying they had refunded the entire order.

Bank money hasn't gone back in but I have it writting now.

Tescos is a better service.

refuse to pay-they promised to repick,they didnt-call asda house at leeds-stop dealing with your local store immediately-give leeds the FULL story,the lies you have been told,drivers turning up at 11.40pm(outrageous imho)-lay it on thick. the manager at local centre has already proved to be a liar so why bother calling them again? go to the top.

I would be fuming at them calling at 11.40pm and waking the little ones up alone , ....never mind the rest, ..do as barky says and go to head office about this . Really bad on Asdas part imo , good luck and dont let them get away with it (_;)

tell them you are not paying and if they want the items back then to come and collect them themselves, thats what we do in tesco dotcom i work in if the customer isnt happy with any particular items they send a driver who is going near the route to collect the items ASAP and in some cases where its only one or two things (Not most of the order) the driver takes them new items. poor performance really especially with a whole order getting drenched in cider and then trying to fob you off with the exact same items that were soaked

Nothing to add that hasn't been already.. But I just wanted to ask if you'd checked your e-vouchers page on your ASDA account?
They promised me a voucher once, I swore blind I hadn't received it, then checked my stored vouchers and it had been sent there instead, It might be worth a look :)

i had a look couple of days ago but they have no suspended my accouint so i cant log in

:| asdas seems to be doing it to everyone i#m going through the same thing now ....ordered my shopping came on time looked at my order online said £152.77 on reciept £151.77 as i didnt get the full shopping i rang to ask what can be done about it i want the rest of my shopping three phonecalls on the same day finally booked for next day ......But ......next day came had a phone call please contact asdas delivery bla bla to get to the point.... they demanded i paid the full £152.77 now!!!!!! was her words i put the phone down and rung the bank made it clear to let me know if asdas even attempts on taking double payment to refuse due to the pending payment thats is already waiting for asdas to take! my astonishment they didnt bloody bother !!!!! they have suspened my account they hung up as soon as my my name is mentioned my emails have not been replied too and to my shock horror the complaints site is no longer available for my ip any ways?so how do i pay FOR the items that did turn up Ohh it is not the first time they sent a half filled order but payment went in fine week b4 but i was still overcharged but i foolishly didnt complain about the missing items than, but this time was allot more it seems you compliain to asdas ,........you seem to have have major probkems left to deal with after .......but honestjy how do i pay for the items i got ????

Dont pay fot them,i didnt contact them,they havent contacted me......quids in,i am not chasing someone to tell them i owe them money
