Am I being scammed?

I recently sold my copy of Black Ops to a HUKD user in this thread:

I've always kept my games in mint condition. I've never had a problem before with the half a dozen or so trades I've done on here before.
All was tickety-boo until I PM'd him asking him if he received it okay. It is claimed that the disc doesn't work and asked what I was going to do about it. I was about to offer a refund, but then got suspicious and reread the thread. From his wording ("Don't care what condition it is in as long as it works" and "don't worry about photos") I now have a feeling I'm being scammed. If I offer him a refund, what are the chances that I'm likely to receive his previously owned damaged disc back? What should I do? I've never been involved in a dispute on here before.

The problem there is I have no proof that the disc I sent wasn't already damaged except for my word. All my games are kept in mint condition, and I was stupid enough not to take a piccy and post it in the thread before selling. I knew there was a reason I usually stuck with trades! lol
Taken your advice and have done that explaining my problem in the message field.
EDIT: obviously he could damage the disc, and then return it to you. Which would not be good.
Or, if you are a 100% genuine just tell him to **** off. Worst you will get is a negative feedback which in the grand scheme of things is nothing.

The problem I have is I think I'm not going to get the disc I sent him back. I reckon I may get a damaged copy of the game that he already owned but didn't work on his xbox.
Overekill? maybe but it solves any problems if they arise!!!!

I originally had the game available for trade, but no-one was interested. I was responding to his "Wanted" thread so it didn't occur to me to take photos or the like.
I've offered him a refund now provided he posts the disc back to me by recorded delivery and the disc is undamaged which is the condition I sent it to him in.

NO offence or anything, but did you not read the OP? You have asked for info twice now even though the link is given in the original message! :D
No, not new to HUKD. I wouldn't have sold it to a new member (mainly because of the risk of getting into the situation I'm in now. I like how that worked out!) X)
