Hi, the missus stupidly bought a designer bag (using my account) from Ebay that turned out to be fake.

Emailed the seller and theyve offered a refund but opened a case through Ebay asking me to cancel the transaction. Shes asked me to send the bag back first then she'll refund the money?!! Should i not get the refund first then i send it back?

I've not responded to her cancellation request yet but have went through paypal and opened a case against her.

So what do i do next?

You need to send the item back 1st then you get your refund. Just the same as you would with a shop or a online retailer. Make sure you get proof of postage 1st when you send the bag back :thumbsup:

don't reply to cancellation bit just yet, tell the seller in an ebay message you will do this once you have been fully reimbursed your money. Otherwise they could play the funny burger and say they haven't got your item yet still get their fees refunded.

Really you shouldn't send fake items through the post as it isn't permitted. If you can get verification from a reputable retailer who sell the item, probably harder to do than say, you can submit that to paypal as proof and they will close the dispute in your favour. If you cannot do this send it back and make sure you use a fully traceable service, not just recorded delivery, and demand that the seller reimburses you your full cost inc. returning of the item.

Raise a Paypal dispute and add the tracking details in the dispute area.

what sort of feedback does the seller have? as in number of transactions? if a new seller get the money first!

I'm pretty sure the rules have changed on ebay regarding fakes, from memory i think you have to send paypal or ebay proof the item has been destroyed and then they will give you your money back.

Ring ebay.. They are great with stuff like this..
Someone tried to rip me off with a phone a few months ago.
Things included in sale that didn't arrrive...
Rang ebay after my email were ignored by the seller, opened a case....Other party emailed me within an hour with a message to refund for items not inc, or full refund.

Case closed..

Do not accept the cancellation request, do all the comms through eBay or paypal disputes now and see what they say. If the seller wants to cancel the sale directly with you I think you'll then have problems opening disputes through the proper channels if you need to later on as the sale was cancelled.
If you get a refund make sure it is a refund and not a payment (which can be reversed) and if you're happy enough then do the cancellation thing and leave appropriate feedback.

The person has 193 Positive 100% feedback.

So...should i just send back and wait on the refund or ask for my money back first?

no drew do not send back 1st! without a refund you will lose out or the misses will rather!

remember once you have returned it you cannot prove it was fake, should they decide to refund you minus postage cost both ways, to report a fake via paypal you will need written proof from a retailer it is fake, they will refund and ask you to destroy the fake i belive

is that 193 of sales or 190 purchases they have made of 1p items.? Read their existing feedback for an idea of how good they are. May have some comments about previous honest refunds etc

Its a mixture of both, just has bought and sold a lot of girlie things (i.e make up, clothes, bags...etc)

And i've already started the paypal claim selecting the section where it says the item received was a fake...

Should i just send her a message asking her to refund the money and i'll send it back as soon as i receive it?

if you have started a claim, then leave it with them, you dont need to contact the seller by any other means now, but you will need to prove its fake

well paypal have sent them a message asking for a refund. I'm gonna PM her and tell her that as soon as i receive the refund i'll post it back and thats the end of it. Just want my money back quickly.

the idea of a paypal dispute is because it is done properly, just leave it with them, paypal will not tell her to refund you till you have proved it is fake, and she isnt going to refund you without you returning the item
