fill out a returns form on amazon and see what they say, they refunded me when my teapot broke past the normal returns period.

on the main page, scroll down to the very bottom, under the column "Let us help you", click on "returns"

on the right side on the next page there is a contact us button, choose how to contact them, i used email, fill in your details and send.

i dont believe they have to replace or refund, they can offer to repair and if found it is not a manufacturors problem then you will have to pay, but amazon are very good and usually refund

We had it about 6 months and we lost all sound, they were very helpful. I think they contacted manufacturer and we were sent a prepaid bag to return it in and 48 hours later it came back fully working, (or maybe it was a new one) it is still working fine now.
