Take back to Argos, they usually really good and simply replaxe stuff.

Just ask for a replacement there and then. Pretty sure they will. You well in your rights.

No you are not , the shop can insist on a repair, replacement or refund the customer does not get the choice.

Well Argos have always offered me a replacement straight off.

Same with Game/Gamestation/woolies(RIP) etc

Yes that is up to them, but not your right under consumer law, they shop can decide what they want to do :)

Toys r us were also great too, our sons DS broke two days before warranty ran out and they just swapped it no question of repair.

It depends who you get serving you.

I took back a TV that was 11 months old and they insisted on sending it away - took it to the next store and they refunded me for it :)

If you are sure nothing is stuck in there just take it back and ask for it to be replaced.
they don't have to replace it but you stand a very good chance as long as you have the reciept.

Why? It's a few months old, and Nintendo have no responsibility to do it free of charge.
