Busted DSi from Argos, what can I do?

I bought a Dsi for my daughter for Christmas and basically it's busted, keeps coming up with some error code, tried googling and general consensus is that it needs repair.
I don't want to have it sent off and wait 3 weeks, does Argos have to give me a refund?
Want to check out where I stand before I start hammering on their door this morning!

Only thing is they don't have a blue one in stock (you know what kids are like!) thought if I got a refund I could get one somewhere else?

As a gesture of goodwill they will most likely replace for the same or different colour, officially it should go to nintendo for inspection first and if necessary, repair, which depending on the manager on the day is what may happen.

Asking for a refund is pushing it though, they dont have to give you one.

***You dont have to go to the same store that you purchased it in, is there a blue available elsewhere locally?

are you using flash cart in it or is this with normal games?

if you have a recipt ask for refund if they dont have the same colour in stock

If its within 12 months, argos will replace no questions usually - but if its out of stock what do you expect them to do? Magic one?

You can however take it back to any argos store, so find the nearest with stock and drive there if its so important.

They will send it off for repair for you, it is around a 2-3 week wait though, thats why it will be easier for you to find a store that has it instock, go straight there, and try and get a swap.

Argos usually replace or refund. I had a microwave that bust after 10 months and they refunded the cost. Any Argos store should replace the DS, go online to see if there are any available elsewhere.

Then it will be their discretion, most likely will offer you a swap for a different colour, or as that colour is important they may offer the repair service. There are two blue colours in the new collection, does your daughter like the other blue?

They do have to give a refund if its within a 'reasonable' time

Thats what I would have thought from a major chain, I now see they don't HAVE to refund but surely a kid's Christmas present that was sold faulty?

It's true of any big store - same with supermarkets, comet currys you name it. Any chain store pretty much.

I personally think your just after a refund for some reason, because you seem to be being deliberately awkward.

However, argos are usually spectacularly good with refunds etc, and at the very least will give you vouchers (which you could use immediately to get another colour)

receipt + faulty (on high priced electrical goods where a repair facility is available) = repair

After 30 days from sale, a UK retailer has the right, where available, to inspect the fault for customer damage, as this cannot be carried out in store, the item would be sent to a repair agent (in this case directly to nintendo) for inspection, and if needed, a repair.

Due to the xmas period managers may, at their discretion, replace the item for a like for like product, or if the colour is important you may be lucky to be offered a refund in argos vouchers.

People automatically think Argos is a pushover in this area, just because they have a great track record for customer services, doesnt mean that they replace & refund anything, they wouldn't be there if they did.

Goods need to be of mechanisable quality.

The OP is quite entitled to a refund if that's what they want.

Anyone agreeing to a repair to a faulty item within 30 days of purchase needs their head examined. As soon as you agree to a repair, all your rights under the SOGA go out of the window.

OP forgive the above poster, for they know not what they sayeth.

Go back to Argos, armed with your receipt and faulty toy and get it replaced not repaired. If they dont have the right colour, insist on a full refund. If they try to get funny (which Im sure they wont), just ask the magic question to them..... "Have you heard about a law in this country called the sale of goods act." That would soon get them scurrying off to the till.

if they dont have the same item and thats what you want you are fully entitled to a refund providing you have the receipt, if you dont have the recipt then you will be relying on the goodwill of the store. there is some incorrect advice itt

I'm really not trying to be awkward, I just know the reaction I'm going to get if I walk away from the store empty handed, it's not my fault they sold me faulty goods, all I want is an exact replacement (which doesn't seem possible) or a refund, is that really so much to expect???

If you have the receipt they will refund if not in stock. However please note that the refund will be in the same manner in which you paid ie back onto your debit card or credit card if paid by card or cash if paid by cash.

I completely understand their refund process, you are assuming the good where purchased within the last 30 days, I was assuming they were not.

If you read my subsequent replies, you will see that I have explained the importance of the initial 30 day period to the OP, thus offering the advise they wanted, advice that was correct.

I love it straight to the point, but don't think argos opens until 11 this morning, or is it 10 (shall I start a new thread?)

It depends - did you buy it for this christmas or last christmas? If this christmas, ie: a few days, then you will get a refund. without question.

If its over a year - its store descretion, despite what the usual nutters are saying and quoting the half made up 6 year EU ruling. Argos are pretty good, but after a year it might be pushing it.

You are quite entitled to send it to the manufacturer and hav eit repaired - and your kids make no difference to that, its tough.

Why would you assume they bought the goods over 30 days ago? They said they bought it for Xmas. Why would you think they bought it last year?

Guv, I am talking about the repair in terms of the OP, where I am assuming the goods are over 30 days old.

It was purchased for xmas, meaning it could, theoretically have been months ago.

Please read post 19 again, and look directly under the line you choose to quote me on, you will see that I explained the procedure and also explained that it will only be applicable if the product is more than 30 days old.

We both assumed the goods where over 30 days old, as the OP created this thread.
