Can anyone confirm if a company has to tell you they're selling you an import electrical item...ie a Nintendo DS.

Bought a DS lite from SoftUK and it looks like there sending out American models although there site does not tell you this. They are a UK company.

Also will Nintendo honour a USA warranty here in the UK?

I have to wait to get in from work to see if they have sent me a USA model - but if they have I will be straight on the phone asking for a UK replacement or a full refund including the return postage fee. Not going to be happy..........

Well, by law you have a leg to stand on because the item has been misdescribed.

I think Nintendo US do offer warrentys to the UK - however you cover postage.

But they are a UK company - so why would you / I / consumer think its an import?!

If I purchase an item in the UK I do so to get a UK warranty, I dont expect an import with a invalid warranty / or extra problems should I need a replacement.

under distance selling laws yuou have 7 days to return it anyway.

The 'warranty' is provided by the retailer anyway, if you need to return it, you use the Sale of goods act.

If you require a defintive response to your question, it would be better if you contacted an official body such e.g. Citizens advice centre

- They will more than likely just refer you to Trading Standards and or Consumer Direct.

I thought I should post to help put any concerns at rest.

Firstly I would like to confirm that Softuk offer a years warranty with the purchase of this DS console. We will replace or repair the console if a manufacturing fault or error is found. We will not replace consoles that have been damaged as a result of mistreatment or neglect.

I believe previous posts have already confirmed that the imported DS Console is identical to the UK version and therefore will operate just the same as the UK version.

After reading this particular thread and taking all comments on board, in the future we have decided to make customers fully aware when we are selling imported consoles by stating this in the product description.

I hope all that have purchased this product are enjoying it.

Can you ask one of your staff to contact me as they promised. (Order ID : 831292387)

I phoned and left a message on Tues morning, I e-mailed on Tues morning.
I then phoned on Wednesday after not being contacted on Tuesday. I was promised a call back.

I am still waiting for your staff to tell me what is happening. It's the 1st time I have used your company. It appears like it will be the last.
