Can my landlord do this?

My Landlady is a nightmare, as stated on previous posts the neighbours are party animals and have sex parties all night, or slam doors or have dogs barking, sewage overflows when you flush toilet or use washing machine fire alarm ripped from wall with bare elecric wires coming out of it, damp so bad we always have sniffles and the lightbulb in hall sparked and fused and once in my eye making it numb for a day and me half blind for a day. Toilet leaks, fridge broken, roof needs new tiles so every time it rains place gets flooded, seagulls nesting on roof.

Now the landlord is REFUSING to repair to repair this, we did get the Enviromental health round and they werent bothered apart from the damp which has made me fall and hurt back and im still in pain now. And they quote dont need to fix it as the Enviromental health say its liveable in and im in arrears with rent, when the only arrears I am in are I get PAID housing benefit in arrears but she claims I never paid 3 weeks rent when I moved in which I did.

Now what can I say before I explode with anger to her. and swear and scream at her.

Why don't you just move out? Move in with your Parents, make it up with your Father and ask him to help.

I DONT want sympathy I want advice and where did you get im on bad terms with my father from we are on good terms it just will cost about 100 pounds to move and I CANT move until my 2 month contract ends with landlord PLUS they live 100 miles away.

Find somewhere else, Just don't expect the deposit back.

Well thats 400 quid down the drain.

what I was going to do is withold rent until its fixed that way I will get deposit back but I hate not paying bills.

Have you done anything about your depression?
Have you kicked your flatmate out?
Why ask for help or advice when you ignore all of it? Loads of members have taken the time to help you and you don't really want their help or advice, do you?

What do you think will happen hes gonna homeless, so youd rather hed move out now and I lose his HB so I will owe landlord an extra 50 a week.

If you are in arrears (as your landlord is saying) then he will withhold your deposit anyway.

Best advise is to just leave, housing benefit will still be paid for one month, after you leave if you are still within a lease because they will expect you to give your Lanlord a months notice to which most accept.

Your parents may live 100 miles away, but surely a bit of time spent with them before uni rather then getting increasingly stressed where you are would help. Its not that far and surely you can get a cheap coach fare.

With regards to your flatmate, he is doing nothing to help you so why worry.

Well the thing is I cant just move a id need to hire a van and a driver, and my parents dont have space.

If I could say get a cheap removal company and move into my new place early then I would jump at the chance!

i agree with dino tbh, go and see your citizens advice, do something about it, if your landlord are in the wrong they will help you sort it, an internet forum cant do what they can

im sure your parents would make space to help you if they knew the extent of your problems, and look in local ads for 'man with a van' and stop buying gadgets and games and use the money for that

Not him again!

Can you not see the words "Can my landlord do this?" im asking a question, YOU are the one being attention seeking by jumping down my throat.

So much for not critising oh well.

Oh and I have already gone to trading standards, local council, housing aid and citizens advice and all they say to do is withold rent.

And no im not in arrears as such I just get paid housing benefit in arrears i.e its paid a month behind.

PLUS its paid direct to landlord so it never even touches my hands.

I buy things after selling things, dont know where you are getting the idea I have no cash from when I have savings from work.

If Environmental Health say that it is liveable. Then it can't be that bad. They don't just visit for something to do. If there was a problem then they would have taken the matter further. With regard to the arrears, they and the Landlord are both saying this is true.

This being the case then the Landlord can basically do whatever. You have said about you flatmate causing damage before. I'm sure that Landlord doesn't want a property that is getting into a mess as it will be hard to let after you have left. There are two sides to every story. We are just hearing the one.

Once again it is everyone elses fault it seems.:roll:

Im am not making an ass of myself either. I think you find that there is only one crown for this title and you are wearing it.

Dont take my words out of context can you not see the "lol" im making the most of a bad situation.

Plus I like you PrissyMiss lol really I like your replies to loads of threads.

As for the van, whats the point of spending £100 or more and spending over a week packing and getting rid of old stuff just to move a month later and spending another £100, as I say if I can move sooner I will I would be glad to.

The word "lol" is an acronym meaning "laugh out loud", If anything you use this out of context, Just because a word has "lol" at the end, Doesn't mean its not serious.

I myself am in the process of packing to move on the 13th and I will have to move again after christmas. I can't see how you have that much stuff being a single guy in a flat?

Anyway, September isn't far away, just get out of the place more so you don't have to look at it. Have a few drinks and calm down in the evenings when you are there and maybe things wont look so bad.

Peopl live in far worse conditions all over the world after all.

It's YOUR flat, you decide how you want it to look.

You asked a question, why don't you get proper help? The members on HUKD are not qualified, you want to speak to someone who knows about this stuff.

There is always official advisory centres who are trained to advise tenants.

Why not spend a couple of minutes looking them up then calling then?:whistling:

Nobody can advise any more that what they have done in the past, If environmental health don't do anything, The landlord won't do anything, Your mate won't do anything, Its down to you.

If you can't move and the landlord won't do anything, Make the most of it untill you move for Uni.

And how many times do I have to say I already have been to CAB Trading Standards, enviromental health, I even tried a local advice line.

I dont think theres much more I can do.

And I am making the most of it, I just want to kick up a fuss at landlord as I dont want them to get away with treating tenants this way, now im happy to pay rent, I paid it quarterly in advance when I was at college, and I paid whatever top up was needed after I left and kept the flat spotless as I can.

btw still getting those pics so people can see flat.

Now this is sensible, and I agree im working a lot voluntarilty to get myself out of flat.

I have a lot as its all electrical i.e dvds games, consoles etc.

and I have a massive collection of books.

And I moved in as the flat was ok when I visitied it apart from waiting for new tiles and the damp hadnt occured then.

And when I moved in landlord offered me £50 to clean place and promised tiles would be replaced the following week, and as I had a van full of stuff waiting I and nowhere else to go I accepted.

Come Sept, as you are moving out, then it won't be your problem.
As long as you can sit it out till then, then there isn't much point in worrying about it.

So, if you have been to these people and the can offer you no help and/or advise, then you already have your answer in that yes, your landlord can do this.

The question need never have been asked in the first place. I wouldn't bother trying to cause any bother with the Landlord at this late stage and it would backfire on you when they use any excuse to withold your deposit.

Next time, I suggest going through a letting agent (as more chance in getting work done, plus that have to have all the service cerificates up to date). Ask to speak to the previous tenants. And have a good look round before signing anything. Lesson learnt now.

Let's clear this up, once and for all.
You have been to numerous 'official' organisations and they have told you there is nothing wrong with your flat. Is that correct?

If so, why are you asking 'Joe Public' on here?
