Can someone please advise me?

Hi
I was wondering whether anyone can advise me as to what my next step should be?

Basically we have a commerical property on lease and when we first signed the contract we had to give 3 months deposit as a rent deposit (in case we run off etc...) and it states we should receive it back from the landlord whichever is earliest: a year after or we give up the lease. It has been over a month now and we have contacted the landlord and they say we should contact their solicitors and have done so via phone and he said I don't know who you are and it is better to get it in writing so we sent them a letter last week and still have not heard a thing.

So should I write to the landlord now or to the solicitor again? It annoys me because the landlord always ring to tell us to pay rent even though we havent paid late at all but when it comes to our money hes like I don't recall.

I would contact the landlord again. It should be him that gives you back the deposit if it was you that gave it to him. If you dont get any joy i would go to citicens advice and see what they suggest.

Hi Brillangel, I know with residential deposits the landlord now has to insure your deposit in a scheme - if the landlord fails to return your deposit you can sue him/her and get 3 times your deposit back. Thats what we told him that he should pay us back but he said he doesn't know anything about it and that it is all sorted out by his solicitor it just seems they are pushing the blame between one and another!

Thanks for the link I will have a look into it. I know it states in the deeds that he will have to pay the full amount plus any interest incurred but not sure what kind of bank account he has put it in and whether it now has been a month over the date he is suppose to give it back was wondering if he has to pay interest on that.
