i did genuinely miss the post of the other guys and just said in the pm i would take it but when i went to post things seem to have been done wrong

Looks conditional to me. That sort of thing should be sorted before a deal is struck. Very messy dealings though mate, see what happens when PM's start flying?

see i already asked for that which i wouldnt have done if i didnt want the thing to be honest, although to be fair i never said yes i wanted it until i got the ebay message and said i will take it in my reply. (stupid i no)

and before i made payment i asked who got it and was told me.

Have i broke the rules?

Probably. But even so you'll likely only get a 1 day ban :lol:

Not clear whats going on tbh, convoluted just doesn't cover it. The seller expected paypal but the other buyer suddenly switched to BT. Maybe the seller didn't want BT. They did say they would accept £85+PP fees, which would indicate they wanted the transaction carried out through PP. So the acceptance of the other buyers offer was also conditional at that point. So no deal was technically stuck.

I really don't know, but as its been paid for there's not a lot anyone can do about it now apart from a few slapped wrists.

For future ref though, make sure you both post clear acceptance.

i know now to do that, but if you look there never was an acceptance of the 85bt so mite just get out of it.

(3) Offer and acceptance of trade or sale must be posted in relevant thread. You must NOT deal by PM only .


Now to me that reads thus : As long as you openly express an interest you can ask questions etc via PM, but acceptance and offers should be public only:?

to be fair the deal was done openly?

The only thing done on PM was me saying i was interested, see question on do i want it or not.

I said what i was willing to pay and from the 2 offers mine was accepted?

That's what i'm saying, I don't think its actually against the rules to PM somebody when you are trying to trade, unless you haven't openly expressed an interest (as you did). Let the mods sort it all out, FS/FT is a mess :lol:

This is all about offers and acceptance. According to the forum rules an offer has to be accepted for it to be classed as a deal.

Ok first thing, Seller does not state what payment methods he is taking.

Post 34 - Rudz offers £80 all in. (Offer - never accepted)
Post 35 - Seller stares he will take no less than £90 (Counter Offer)
Post 36 - Allstar2 asks if the £90 includes delivery
Post 37 - Seller says yes but extra for paypal.
Post 42 - Allstar2 asks for other feedaback
Post 43 - Rudz ups offer to £85 (Offer - never accepted)
Post 44 - Seller tells Allstar that they have other feedback and can PM.
30 minutes later
Post 45 - Seller tells Rudz that if he can add paypal fees on top of the £85then its theirs. (Offer)
Post 48 - Rudz offers £85 via BT - (Counter Offer via different payment method)
Post 49 - Allstar2 confirms that they are offering £90 plus paypal fees. - (Offer accepted by seller in post 51)
Post 50 - "sorry rudz allstars2 pm`d me whilst i was typing in forum." - This is the killer!

Post 51 - Seller tells Allstar that its theirs (agreeing to £90 plus fees from post 49) - (Acceptance from offer in Post 49)
Post 54 - Rudz complains about posts not being done in thread
Post 56 - Rudz beleives that he was offered it first.
Post 57 - Seller confirms Pm's were just for Ebay details (This should have been done on the thread not via PM)
Post 58 - "He posted this after he made the offer to me, a deal was not agreed at this point, anyways reporting to mod" (The seller offered the goods at £85 plus fees (wanted paypal payment) Rudz countered with £85 via BT - It was never accepted by the seller)

As I said its all about offer and acceptance. Lots of offers but no acceptance by anyone until post 51 which was in acceptance to the offer made on post 49 by Allstar2.

Allstar2, next time, keep ALL correspondence in the thread as this did not help things I feel, but no, you have not done anything wrong and I would be surprised if you got a trading ban because of it.

The fact is that none of Rudz offers were never accepted (they were counter offered by the seller byt Rudz never accepted any of those either) and yours offer in post 49 was, so its yours as per the rules of the forum.

Even this is really not acceptable to be honest, only because it causes problem as people who lose out in deals think that other things have gone on in PM's.
