CANCEL VODAFONE CONTRACT - PRE-XMAS

If you have had a vodafone contract from phones4u since before christmas you can cancel it FREE.

Under clause 42 it states inc. 17.5% VAT however the VAT is now 20% and they legally have to charge 20% which adds about 32p on to your contract which wasnt what you signed and agreed to.

Hope this helps

Sounds like b****cks to me!

Are you sure this is the case.... they usually have a clause that says they won't increase the price except where required to by government legislation (or something along those lines).....

Have you actually used this to cancel yours?
#3
Have you done this yourself? If so, is this clause Vodafone only or can you get away with it on any other networks? Will hold-fire on voting hot or cold until we know some more facts...

VAT is normally exempt from early termination of contracts as the company has no control over taxes, unlike the basic line rental or other service charges.

i think your still on the xmas sherry read the T&C

Hmm, I'm pretty sure there's something in the contract about the VAT rate that would get them out of this...

Evidence or it didn't happen...

why cancel for the sake of 32p when you took the contract out you knew vat was going up i think vodaphone will have a get out of jail free card.

I've been as guilty as anyone in sometimes posting duff deals, but this is in a different league all on its own!

Moved to Misc as this is info / advice rather than a deal

OP - have you got a copy of the Terms? Usually they cater for increases which they say is usually "outside of their control" or something similar.

I am afraid it is never as straightforward as people think it is.

11. Ending this agreement

a) Either you or us may end this agreement by giving the other 30 days’ notice in writing. Your notice must include your mobile number and the signature or appropriate security details of the account holder. You must pay the charges during the notice period.

b) You may end this agreement by writing to us if:

- we don’t do something fundamental that we should have done under this agreement (for example, if there is a complete failure of the network for 7 days in a row due to something we have done), within 7 days of you asking us in writing;
- we tell you that there will be an increase in the line-rental charge by more than the increase in the retail price index (worked out as a percentage) since the last line-rental increase and you write to us before the increase applies;
- we increase your charges in the UK which have the effect of increasing your total charges (based on your usage in the previous month) by more than 10% and you write to us before the increase applies; or
- we change this agreement to your significant disadvantage including changing or withdrawing services (we will tell you if this is the case) and you write to us within one month of us telling you about the change. This does not apply if the change or withdrawal relates to services which you can cancel without us ending this agreement.

Nothing in there about it, the change also has to be more than a 10% so if the 32p bit is correct then the OP's contract must only be £3.20 per month!

And the change in VAT happened 6 months ago; you usually have 30 days from the announcement of a change. This thread is a load of crap.
