ok so my girlfirend just got clamped but im not happy about it. She parked in a carpark and went to use someother shops 1st then came back to look around the shop. Whilst she was doing this someone clamped her car being the reason she didnt use that shop 1st so she paid as she needs the car for work.
Now what has annoyed me is that she has a disabled badge in the car and there are clearly no signs saying your not allowed to do this.
Apart from writing of and complaining which i will do is there anything else i can do?

same thing, no come back then, unless you have a receipt for purchsed goods with a time before the car was clamped

And what does having a disabled badge got to do with it? It isn't a license to park illegally

not at all but if she still went in the shop and looked around you saying if you dont buy anything you should get clamped?

If you've already paid the charge, there are a number of different arguments that indicate if it was unfair. Check if any of the following apply to you:

1. The offence didn’t happen

2. If you didn’t commit the offence as stated, then the ticket’s been wrongly issued. For example, if you were not blocking an entrance, or parked over two spaces, had paid correctly or for any other reason, simply gather the evidence.

3. The signage wasn’t clearI

If the parking restrictions aren’t clearly signed and visible from every parking spot, there’s no contract between you and the car park owner. Only having the signs at a car park’s entrance isn’t suitable as when turning or manoeuvring you’ll need to be concentrating on your driving to stay safe, not any parking signs. Signs need to be visible from all over the car park to be sufficient.

If the signs are not visible, then demand a refund on this basis, but ensure you have photos to use as evidence if relevant.

If you weren’t on private land

Staggeringly, this can happen, if you weren’t on private land (e.g. you were on a public road or in a council car park) and then refuse to pay. Take pictures of your car and of the surrounding area so it is clear you were parked outside of the landowner’s jurisdiction.

There are mitigating circumstances

If you accept you parked in the wrong place but there are genuine mitigating circumstances to explain why you parked where you did, challenge the ticket. See a list of typical mitigating circumstances.

Clamping or towing is too harsh a punishment

If you feel that clamping or towing is too harsh a punishment but you’re willing to pay a reduced fee you can always try to bargain with the landowner, not the ticketer, claiming you made an honest mistake. This will not be straight forward but there is no harm in giving it a try.

The release fee isn’t reasonable

The release fee here only has to be ‘reasonable’ yet this is ill-defined and there’s no set legal limit to what this is, but judgments in previous cases indicate around £150 is the maximum. Again, there is no guarantee this will be successful but trying may help you case.

The clamper prob say her going into the other shops first which the car park isn't meant for so they clamped her? Or were the first shops she check apart of the car park?

point is your g/f didn't make a point to park there and go in the bed shop in the first, it was a risk and she got caught, why whine?

i spos ill tell her that still a royal pain though, and if you park on a public street they cant legally clamp a disabled badge holder( http://www.bluebadgenetwork.org.uk/whatbluebadge.htm) but its down to the private companys discretion. i wouldnt mind so much but the car park was empty and i was goingto buy a bed from them but shall not now.

IF NOT RING THE POLICE FOR CAUSING CRIMINAL DAMAGE TO YOUR GIRLFRIENDS CAR.
IF THERE IS NO SIGNAGE THEN CONTACT THE POLICE FOR CRIMINAL DAMAGE.
IT IS AGAINST THE LAW TO PLACE A CLAMP ON A VEHICLE WITHOUT THERE BEING VISIBLE SIGNS.

not really read up about it, im in a wheelchair and ive got my own badge but i can still wheel myself a fair distance, i can easily wheel myself further and faster than an old person does that mean im not allowed a badge by ur logic

One person asked if the badge was hers so get off her high horse. And if she is parking on yellows/double yellows to go shopping just because she has a badge and isn't in case of an emergency then she deserves to get the badge taken off her. As a badge for crohns shouldn't be used to take up a disabled space from someone with a phsical disability which means their mobility is impared unless its an emergency

No as you need the extra space a disabled parking space gives to get your wheelchair in and out of car.

No it doesn't. If you have crohns you can be in severe pain from it and need access to a toilet in a hurry so a disability badge can be important but shouldn't be used for everyday things only in an emergency

i think ill just write of and see what they say, just annoying and yes Paddy Charlie it can get really bad hence she has it, thats why she needs it.
she never parked in a disabled space either just had the car in the window

Sorry Bossy but being able to walk doesn't stop someone having a blue badge, my dad has a blue badge but can walk fine, he just can't walk long distances due to his health.

Normally your posts are OK but please don't generalise, you wouldn't believe how many people star or say something to my dad when he parks in a disabled space.

Bossyboots -The point I was making was the OP telling her to park on a public road because of the badge which is an abuse of what the badge is for. She wasn't parked in a disabled spot in the car park but the OP is making the badge out to be a licence to park anywhere even when she doesn't need it

Exactly, not every disabled person is in a wheel chair... Some have other symptoms including heart conditions and arthritis.

is it me or is this thread just turned abit nasty ... its about the ticket not the ins and outs of his poor girlfriends medical conditions!!

i do agree with most who have said it was private parking for that shop unfortunatley , but i think id contact them anyway and blag and excuse haha x worth a try ..good luck

Right okay back on track - have a good read of the stuff from MSE as there is always loads on there about this sort of stuff. I hate clampers and never had my car done but if I did and felt it was unfair I would also persue it.

I do agree with everyone else though, your gf parked in a private car park and didn't head into their shop. There is one shop in our town that does this, if you can't produce a receipt for the shop then you get clamped. The shop is pretty specialised (garden / home shop) so if you go there, you would be buying something.
She might be able to appeal to the owners good nature, saying she had a look around the shop blah blah and was intending to come back and make a purchase at a later date.

cheers yeah ive looked over the stuff from mse and ill write and see, its a bed shop so i doubt every customer who goes in there a wanted to buy a bed straight away, most just want to look around 1st.

If I recall correctly; if the signage doesn't mention any thing about a release fee, then it would not be legal for them to charge one.
