I wonder if any of you clever folk can help me with something - basically my partner has been signed off sick with depression and has been off his work for about a month now, he does sales and he has a company car which i imagine he is paying for in his tax code, however his employer came and took the car away, is this right? Many thanks!

It's a company car.
He's not currently working for the company.
Why would they let him still use the car indefinitely?

Yes i know but is he not paying for it? I see where you are coming from tho!

Not seen it happen before, but depends on the company. Lets face it times are harsh atm, they can use the resource elsewhere.

I guess so, never heard of it happening before either! Many thanks just wondered if anyone had any experience of the same kind of thing!

Could always phone them and ask. I'm guessing you used it as your only vehicle for personal use.

He will either be paying for it directly (such as £200 a month comes out of his salary) or more likely by the sounds of it he doesn't pay for it but it does count as a benefit-in-kind when they are calculating his tax. Thus as long as they adjust his tax for the period he doesn't get the benefit of the car, it's completely up to them when he is allowed it.

check his wage slip for tax code

if its lower than 647L you are paying for car through tax - means £6470 is tax allowance so the more benefits he gets the lower the tax code - also j or k after it

see here - might help

http://www.hmrc.gov.uk/calcs/cars.htm

if lower should contact tax office and let them know he doesnt have car no more so tax code can be altered

had to edit as i put higher not lower - doh

at least he should be about 20-30 a week better off if the taxman accepts this but as its really "part of the pay" the company should make this up in higher wages while he does not have access to the car.
