prob a long shot but do any of u guys know anything about a council house request as i m clueless
im currently looking to exchange a 2 bed place for a 3 bed after the birth of baby girl, my family recently advised me of a house becoming empty nr me as shes brought somewhere not able to swap obv but can u request a house with the owners permission and be given it on the understanding we hand back ours or would i have to wait for a transfer- council expect u to wait until ur children are 10 for this and i dont want to do that.
id sooooo love any advise or help on this

not 100 % but sure if you have the owners permission and the house meets your requirements (etc you need that size ) then they have to consider this

Depends what the Transfer policy is with the LA. Mutual exchange would be more realistic for you I would imagine. Councils are generally obliged to go with the most needy people (and I would say that won't be you).

If you have a lounge and or dining room, they both count as sleeping accommodation, so you won't be classed as overcrowded.

i have no clue, this house is perfect for us but as they leaving we couldnt do a swop and her family is too large to mover here. she has 4 children! we def need a three bed though and im a approved to foster so if we had another room id be able to do this and im not sure if that would be taken in to consideration but i dont know where to look or who to ask and id rather know as much as i can before i speak directly with the housing officer

i think u can swap with any of the housing assoc etc,there are a few websites on council house exchanges etc worth ur while registering
and yeah as long as the house wasnt to big for u or ur house too small for family u would be exchanging with i cant see there being any problems

some have different gudlines on kids sharing,i think with my assoc they are not suppose to share if there is an 8 year gap or more in age

Bets thing you can do is ask her to not move yet. And do a mutual exchange into her place, then she can move and you've got the place you want. You may need to bung her a few quid.:whistling:

yes if we wait for a transfer on points it would be forever so we were looking for a exchange. we r a flat and i have my brother with special needs every third weekend and id like to foster if i got another bedroom as im already approved but im seeing if we could request the house with the owners permission or its it a complete no go? thanks x

i dnt think you can transfer like that, only would be able to if its a mutual exchange, but that may just be down here. as the house would have to go back onto there bidding system. also like the OP sed before if you have a lounge or dining room thats classed as a sleeping room so they wont be able to class you overcrowwed

i don't think they will let you, my sister asked after a house which she know was empty and they didn't want to know :roll:

you wont be eligible theres a well long list in every area, if shes givings it up then it will go to the next name on the list

what you could do is do the swap with her before she hands back the tenancy then she notifies the council once the swap is done that she no longer needs it - otherwise no you would not be able to have it as it will be done on a needs basis and as you are not at the top of the list someone else will get it - if is was as simple as getting someone elses permission cos they no longer need it or else we all would just go up to estate angents and ask the people who are buying 'are you a council tenant who no longer needs your property' - life is not that simple im afraid

Meet her. Tell her what you need and about your situation. If she will mutual exchange with you, you are laughing. They cannot turn you down as this is outside choice based lettings or any housing waiting list.

Go for it. Quickly.

Yes she would generally need to give 28 days notice.

yeah well it gets complicated so follow me here...
we have been offered a house locally as she wants to move here BUT its in a horrendous place and not great for work and i dont drive etc etc so do u think if i said we had agreed a swap but that i didnt drive and its far from my little boys school and i knew of a house becoming empty could we do a three way swop ie they move here i move to the house becoming empty and the house thats too far a way becomes available to the assosiation again? so u think theyd listen to that idea? or am i mad?



im not being a cow or ungrateful just looking for the best options for my family and ur advise is very very much appriciated xx

TBH i doubt they will go for it, too much hassel for them and plus they will prob screw it up anyhoo and you might get stuck in the crap house, ask her if she can doa mutual coz as soon as she tells the council she dont want it no more that place will be given to the next on the list asap

pink thats what i thught prob be the case, our falt is stunning and ive done loads to it but the other ladies house is just awful shes special needs and needs a flat as she has mobility probs but i was hoping they may say long as they get a house back they might agree or whats the best thing i could do?

No. It won't work. They will be obliged to use the waiting list or CBL (choice based letting) system.

so u think its a no? the house thats horrid lol is too far out fofr us but only has 2 tenants, so not overcrowding here just wondered if they would let me move to the other house as the one with the lady with mobility probs really is unhabitable!!! - she lives in a 3 bed but cant cope and wants this 2 bed but is my only hope with the assosiation just a straight foward swop. jus love the house due to become available so much LOL. never easy is it :)

tbh, your best bet is to just watch what comes up and keep waiting ive been told i have to stay where i am till my DD is 4, which i think is wrong but thats the way they do it

Mutual exchanges are all down to the tenants. If you or the other party have no rent arrears or outstanding ASB issues then you can swap and your landlords are obliged to let you.

As I said. I would see the tenant of the property you want (the one due to move out) speak with her and tell her what you have told all of us. You can ask her to do a mutual exchange with you now, and she can move out when she wants. When your place is empty YOU pay the rent on it (so you will be paying rent on your old place AND you new place and she can terminate her tenancy from your place (giving 28 days notice). It will cost you 4 weeks of rent (at your current rate) and she doesn't even have to move into your place.

edit: sorry that sounds confusing. I will do it in stages:

1. Tenant of the place you want (property 1) does a m/ex with you (property 2).
2. Property 1 exchanges with property 2
3. Property 1 moves home (into the place she purchased)
4. Property 2 moves into property 1
5. Property 2 terminates tenancy straight away (giving 28 days notice)
6. You pay the rent for the 28 days
7. The council or HA relet property 2.
8. simples!

council will say no to that as ours is 2 bed and she has 6 people so be overcrowded and they prob know somthing suss.
do u think this would work-
I should ask the lady with mobility issues to swap in a couple of months explaining to the couple we will swap but not ready to for a couple of months. then do a 3 way exchange move in to the nice house once shes moved into her new house and then let the people move in to our flat and the the she tells the housing assosiation shes brought a house and no longer needs the grotty house. we cover any rent the people in the nice house would need plus a bottle of champagne :)
am i mad? is this possible? a house becomes free for a needing family regardless, the mobility couple are sorted and i get my dream house :)

This is if the lady agrees? long shot really but she wouldnt lose out ahh i dont know but im thinking it would be a 3 way swop just the other house would become free instead of the one i want :)

3 way exchanges are possible, although obviously more complicated. Go for it!

As for the overcrowding issue, it's a personal choice (and they could blag that some people have moved out).

you wont know the outcome unless you try - it doesnt hurt to ask - but be aware of the consequences if you get caught out trying to abuse the system
