Court fines eBay over fake goods

The French court case began a year and a half ago
A French court has ordered eBay to pay 40m euros (£31.6m; $63m) to luxury goods group LVMH for allowing online auctions of fake copies of its goods.

LVMH said eBay's French site had not done enough to stop the sale of counterfeit bags and perfumes.

The brands affected include Louis Vuitton, Christian Dior and Givenchy.

An eBay statement said LVMH was trying to "protect uncompetitive commercial practices at the expense of consumer choice" and added that it would appeal.

'Illicit'

The case against eBay in a commercial court in Paris was brought jointly by six brands belonging to the LVMH group.

Louis Vuitton Malletier, the group's handbag and luggage section, and clothing brand Christian Dior Couture accused eBay of "negligence" in allowing illegal copies of their goods to be sold in online auctions.

Four perfume brands - Dior, Guerlain, Kenzo and Givenchy - sued for what they called "illicit sales" of their products.

They alleged that even auctions involving their legitimate perfumes were illegal, because only specialist dealers were permitted to sell them.

Considering Ebay is just a conduit how can they be held responsible for the sellers on the site? I wouldn't expect as a retail space within a store the owner of said retail space would be liable for the product sold by a third party vendor, this basically sets a precedent that Ebay may have to inspect goods authenticity before they list them.

By them taking money for all or any of its services holds them responsible. Its about time someone got the better of those robbing gits.

They are only robbing gits if you sell through them. Its fairly cheap if you are looking at putting something you want to sell on a bigger scale and attracting more interest. If it doesnt sell, you dont pay.

They interfer in everyone else's personal life and details, so it is good to see them coming under fire.

If you bought an item from an auction house and found that item to be a fake whom would you hold liable?

Ebay has avoided responsibility for fakes for far too long and this is long overdue IMO! :thumbsup:

i belong to a handbag forum & members on there constantly report sellers of fake designer bags to ebay, but ebay still let these sellers sell as they make quite a bit of money off them... good to know that that will have to be more careful :thumbsup:

Its the same as handling stolen goods, if you're selling them unwittingly, ignorance is not a defence anymore, eBay got what they deserved, good.

eBay...profits of $460 million for the first 3 months of this year!! I guess it might be able to find the cash if it has to pay up!!

**** ebay off but they are giving us a service whereby we can make extra cash

final value fees do pzz me off as you then pay again via paypal - but if we didnt sell on ebay would we do carboots in the rain - winter freezing cold - paying £8 - 10 a pitch - work it out how many items you could list and potentially sell without suffering the elements

At the end of the day though it will be honest ebay sellers paying the fine, it may be funny that ebay have been fined but they have to get the money from somewhere and that will be passed down to us!

Ebay has a monopoly on the type of service it offers, no one else offers the same service when you take into account how many customers they have to offer sellers, others have tried and FAILED. They have us over a barrel, but if you arent happy with the returns dont use them, ebay wont miss the ones that do leave as there are plenty willing (and even happy) to stay!

I think you will find alot of long time ebay traders have got fed up and already left. no protection for sellers when buyers scam you , get charged listing fee , buyers fee , now forced to use paypal so get charged clearance fee too. Ebay paid far too much for Skype so they have increased charges in ebay , the only reason they have the monopoly is it has become a houshold name , how long before a new kid on the block muscles in , Amazon have taken alot of the trade away from them, there will be more to come.

Basically the rights holders are giving the message, you bought our **** now you're stuck with it. Try to sell it on and we'll sue. Big companies like these have been abusing ebays VERO system for years to protect their own interests and a lot of the time its had sod all to do with fakes.

Ya mean when you can be bothered? like the snide jumper i bought and was told it wasn't fake? even though i had 2 signed letters from 2 different shops? they even let the seller start trading again!?

I told them, go search for adidas y3 trainers and then tell me you don't allow people to sell fakes, you frigging money grabbing bunch of corp criminals.
