Dabs selling customer returns

I posted in another thread but thought I might get more attention in a dedicated thread

Basically I ordered a HC35 camcorder from Dabs which arrived today. As soon as I opened it I remarked at how tatty the box was, and sure enough there was a 'QC Passed' typed up sticked covering the broken Sony seal.

Inside the contents were just thrown all over the place, not bagged up/tied etc.

Camcorder was in pretty good nick but did have small signs of use, and the battery has a kind of sticky residue on it.

Anyway my question is can anyone see anything on this page http://www.dabs.com/productview.aspx?quicklinx=3YY1TB to suggest anything other than a brand new item and if not I was just wanting to get clarification this is Dabs problem and I am obliged to a full refund/exchange or compensation with any pickup charges having to be covered by Dabs rather than myself?

The site doesn't say anything about it being a used item.

Phone c/s at Dabs and explain that you want it collected and a new item dispatched or a partial refund (your choice). If you get any hassle, just tell them you'll be speaking to trading standards as the goods were not as described. If they don't cave in at that point, phone your local TS office and an officer there will listen to your complaint and then contact Dabs on your behalf.

did you read the bit about "used stock" ? ... if your order was from the discontinued used stock pile then that would account for the slight usage etc... still unaccpetable in my eyes, demand a refund.

also:
If you have changed your mind and you are a private customer (not applicable to business customers), and the goods have not been in your possession for over 10 days, then you are entitled to return the goods to us for a full refund on condition that you take reasonable care of the goods until they are returned to us.

The 'discontinued' status has only gone up today - The other day it simply said 'in stock'

Well Dabs have given me a RMA number - The thing is the camcorder isn't too bad, so does anyone have any experience of getting compensation off Dabs? As I would rather have a bit of money off rather than return the whole thing

The only thing you can do really, is ask them!

I had a similar - but worse problem with ebuyer. The goods in question were "pre-used" - and they sent me a different camera to the one ordered. (It was a Pentax S60 and they sent a Pentax S50) It was also the second time they had done this - as someone else had leaft feedback to say the same. A clear case of pushing they luck and hoping Id just accept a cheaper and used alternative.

Luckily they agreed to its return and collected it by courier at their cost. Maybe no harm done - but no doubt they eventually managed to be successfull with this deception.

Result - £30 refund (Read:Not '£30 off at dabs.com') and covered for 12 months by Dabs

That link no longer works, how much was it?

I ask because 15-25% is typical restocking fee from the person who returned it, if you didn't at least get that then it would be nice to know what % dabs did give you.

You mean you can actually call Dabs up now?

I bought something from them about 5 years ago, never again, they had no phone number back in those days and they didn't reply to emails either, impossible to contact.
