Hi I know this is probably not allowed but its serious, i was lied to by CS at orange and told i had 7 WORKING days to use the phone before i return now when i have rang to return i have been told…

Hi

I know this is probably not allowed but its serious, i was lied to by CS at orange and told i had 7 WORKING days to use the phone before i return now when i have rang to return i have been told 7 days not 7 working days, so my only way of return now is within the 28 days if it gets a fault.

So now although it is probably wrong (but in a way its not because i was lied to) i need to make my phone develop a fault.

Any help please on how to do this or what the main faults are ?

Because the contract is a little too much, t-mobile are offering a better deal and its only 500MB of internet on orange :(

i think given that you have spoke to them regarding return they will be very suspicous now whatever you do.
unlucky but your prob gonna have to keep it now, there is very little you can do that they won't know was deliberate, and they will most likely insist on sending a replacement rather than terminating a contract.

Your going to find it difficult to create a fault and I wouldn't advise it as it may backfire.

You could always get Orange to go through their call logs and ask for a transcript of the conversation you had with the Orange CS when you agreed to the contract. They record all calls so should be able to find out exactly what was said. It would be long winded though and ultimately I think you'll find it may be easier to keep the handset and sell if you really don't like it.

If a new phone develops a fault, why would they cancel the contract?

They will just send you a replacement phone.
Your stuck with it I'm afraid, surely you knew the contract was too much for you to afford?

I had purchased a Blackberry Bold from Orange that was faulty and returned it within 28 days to get a refund last year. It was helpful in that they had no replacements but I didn't want another one as it didn't match my needs and they had no other Blackberry handsets as an alternative at the time (3G & GPS).

here what i did with the hero when i took mine back without a fault but claimed there was one.

go in and say the headphone port palys up sometimes and that you have read on the internet that other people have been having this problem.

worked fine, they refunded me there and then :D hope that helps

I know mate i dont want it to backfire, infact i dont even want to break it i just want what they said :(

Also how do you know all calls are recorded because when i asked they told me only about 1 in 20 :/

i had the phone about 2 weeks, yes it is a common fault, if you search it on google there are wuite a few results of people with this problem.

mine was from orange.co.uk but i went in store to sort it and they rang up for me. although if you ring up and say the headphone port is playing up. they will offer a replacement. The just say NO i want to cancel my contract under the 28 day faulty goods act. and they cant argue back.

you're sorted - exactly what i did :D

You'll have no luck going in store as the policies differ! You'll have to send it back after calling and speaking to orange.co.uk. Once they've agreed to have the handset returned, I think they'll arrange for a courier to collect the handset if I'm correct or it has to be sent by signed for delivery.

Sounds like you got lucky if you took your instore as orange retail and orange.co.uk are effectively separate business's. I know you can report a fault instore so that someone can see the fault but the handset would have to be returned to orange.co.uk.

You'll come up against many obstacles if you try to take your handset instore.

Yeah i coud give it a go couldnt i, although will it not look dodgy now that i have requested a return ? Also can it actually be broken in some way that isn't obvious ?

BTW does anyone know some links to where it says about the socket breaking as i cant see any after a google search

It may look a little suss but if there's a fault there's not much they can do although they may look into your claim a bit more thoroughly. I was going to suggest somewhere like http://www.androidcentral.com/ may be somewhere to look for any reports of faults with the HTC Hero...

call them and tell them that you was given the wrong info making u upset and now the phone has develeped a well known fult and you feel very let down by them that you dont wish to keep your busness with them i will eat my hate if it dont work or at least get you some thing for nothing maybe the extras the other phone got? if ur a girl (and b4 somone says its not fair if it works uses it lol) cry lol works every time x

If you got it from orange.co.uk the the DSR will apply which do give you a cooling off period of seven working days

Just say the phone isn't charging properly all the time, then say you want to cancel. Simples.

They wont cancel your contract if your phone is faulty, they will just replace it with another handset..
The only way out of your contract is to pay whatever it is outstanding.

Your best chance is to give them a call and explain that its a new contract and you would like to opt out.

website soo far seems like a god send because i got it on the 1st (thursday) and asked to return on 9th (Friday) therefore i have a fair argument since it has not been used since friday dont i ?

As the DSR state 7 WORKING days :)

They are saying due to it having more than 7days USAGE, (1st to the 9th) but it was only 7 WORKING days.. so to put it simple ORANGE ARE PI**ING ME OFF WITH THEIR LIES !

Id suggest a letter to customer service asking them to listen in on the phone call between you and CS, they should be recorded and if the CS rep said 7 days without stating working or not you should ask them for it to be cancelled on those grounds, they have to be clear especially as you tried to take it back

I have rang and CS say differently to returns :(

I told the last person i spoke to at CS if its working days or not and she said yeah its working days so i told her to put a note on the account saying that and she has but still returns are having none of it they are an absolute joke ! :@

Thanks everyone for your advice and i think its sorted now just got to get it sent off either tomorrow or Monday :)
