I had the same problem with 3 with regards to the signal and the handset that kept on breaking.

I went to the shop and told them I was going to cancel and not pay the remaining line rental to which they said I signed an agreement to promise to pay for 12 months. I replied that they promised me a good service but I'd received nothing of the kind.

The manager of the store was out with me for an hour, I had head office involved also.

Within a week I was off the network and never had to pay anything more.

you should have the same rights as a normal purchase, eg returning it within a certain timescale unused in resellable condition - I would check out consumer rights who have a part on the website for mobile phones etc

check out here,

You were very very lucky. Thats the first time Ive ever heard that happen!

I'm unfortunately with T-Mobile and having the same problem. When I called to cancel and pointed out the 9 months of hell with their service and the handset they sold me (which has been swapped 4 times - AN MDA Vario II) they simply said they are giving me a service and the handset is a seperate issue.

I would love to be able to walk away - but now still have 7 months to go. I got sold on T-Mobile for web-n-walk and was told at the time the service had improved since I was last a customer some 5 years previous. I should have dobbed it in as soon as I saw it wasnt really any different from my home address - even though coverage is supposed to be "Excellent".

I actually bought the phone and contract from a T-Mobile shop - so perhaps the trick will be to go in there when its crowded! :giggle:

I'll admit I was a bit lucky. My dad had exactly the same phone and same problems so he went down the next week to try the same. All he got was an offer of an upgrade.

I work as an NVQ assessor of customer service in addition to my job so I suppose I put the frighteners up them with my long words and knowledge of acts.

If you're paying for a service and not recieving it you're legally protected in this country, you have a right to cancel without penalty. If they give you any **** like "but you have to pay the rest of your contract" then go to ofcom: http://www.ofcom.org.uk/ (often the mere mention of them kicks mobile firms into action) and don't forget to send any complaints to your operator in writing and by recorded delivery.

give them a call as we took contract out with them a few years back, and only had sgnal in our garden, nothing our house,

i rang them a really moaned, the handset was one of the nokia n range, cant remember which one, anyway, i kicked right up saying what use is it to me, and after a while they eventually said they would swap my handset over as this could be the problem, and yes it was, so worth tyalking to them, mind you some of their customer service staff arn't very helpful, so try and get one that seem helpful, i do this by just keep ringing back.

good luck worth a try!
