Dodgy Ebay seller advice

Hi Guys and Gals,

Hubby purchased a polo shirt off of eBay a week or so ago and it turned up yesterday. It was described as a genuine Ralph Lauren polo shirt; however it wasnt! I put a claim through the PayPal resolution centre this morning and in 15 minutes it was closed in my favour. The problem is that I requested additional funds to return the item as I refuse to be out of pocket as its not my fault the seller was selling dodgy items. The seller has been in contact and acknowledged the refund and asked for positive feedback and they will do the same! They havent mentioned anywhere in their response about reimbursing me the cost of posting it back!!!

My question is what would you do?

I am tempted to say leave me positive feedback and I will do the same and keeping the shirt! teach them a lesson or would I be just as bad as them???

I wouldn't send it back if it were fake anyway, your not supposed to send fakes through the post, phone paypal and tell them this and leave the negative feeedback he deserves to warn others.

2 wrongs don't make a right.

Tell them you aren't returning it until you receive return post costs. And why positive someone for selling counterfit goods?

You can't force a seller ro re-imburse you return postage BUT as it's fake you don't need to return it at all,make sure you leave NEG feedback to warn others.

i agree we only had a problem once with a dodgy golf club and paypal said we should destroy it. It should not be returned.

I dont thing they can leave negative feedback for you or if they did paypal would sort it out. Does anyone know more about the feedback situation as this will worry the OP

Last time I got a fake item off eBay I filed a dispute with Paypal and then called them on the phone.

Having explained the lady on the phone that the item was fake she closed the dispute as resolved and gave me an instant refund.

I didn't have to send anything back at all or even wait for the ebay shop to further respond.

Just bin the shirt.

You are intending to state in your feedback even if you do leave positive that it was a fake,aren't you?

You have your refund now so you don't actually have to send it back and your aren't supposed to return fakes to the seller anyhow

Yes,I know,but it would depend if the seller was in the habit of selling fakes or perhaps it had been a genuine error on their part and someone had sold it to them as genuine,I'd look at their other items for sale and decide from that

How can that be when the seller is in the wrong and haven't got a leg to stand on. They can't leave negative feedback or leave positive feedback with negative comments. I would just leave him negative feedback then add the seller to your block bidders list so he can't retaliate by buying one of your items in the future.

You can also report him to trading standards and the Police. Had the same with a toe rag selling fake Fred Perry's last year, got my money back and handed the shirts to TS. I also informed the UK legal team of Fred Perry who had his accounts shut down and by the looks of things he hasn't resurfaced yet.

They may email you to ask why you left negative and be a little angry (this happened to me recently and i just ignored it)

They cannot leave negative feedback for you but they can just not leave you any feedback at all .

I wouldnt give it a seconds thought if you got shoddy goods then warn others without fear !

if the seller sends you payment you have to return the item otherwise youve basically stolen the item,doesnt matter a jot that tem is fake it now doesnt belong to you as youve been refunded

Not if you give it to trading standards, plus Royal Mail terms are that you cannot send items of illegal status through their system, so the seller would have to collect it via other methods anyway

The op may or may not have ever done any of which you describe above but i doubt he then sells it on ebay describing them as being genuine!

I don't understand your stance on this,TS tell you not to return the item,if the OP wants to spend her time taking it to TS what's the problem:roll:rather that than return it so the seller sells it on to some other unsuspecting buyer.

You have missed the point here, the seller took their chances selling a fake, breaking the law himself ripping the buyer off.

PAYPAL will tell her NOT to post it back as it's not allowed to pass through the postal system, it should be destroyed or returned to TS, so it can't be sold on.

Hi jamstaruk1972, Thank you for your response; however the local trading standards office is 1.6 miles away from my home address and I walk past it on a daily basis, i will not be out of pocket and yes it is great to be so honest x :thumbsup:

What's your point? It's totally irreleveant to the op. A seller sold her fake goods, she cannot return them through the post legally the only option is to destroy or retun to TS, this is standard practice on ebay.

It may make the seller think twice before selling fakes, although I doubt it.

Your UK TV Licence sadly wonlt extend to programmes on US channels or subscription based UK channels....

Not that I'm in either camp as I openly admit to downloading movies and TV shows...

Using Demonoid doesn't mean anything, Ok you can get copyrighted stuff from it but often use these sites for non copyrighted material or for new bands who often post on there with intent for marketing purposes.

Why the hell should that be in question, it's none of anyones business. The question was how she deals with the seller as she does not want to be out of pocket for return postage for a fake.

Fakes don't have to be or should not be returned, that's not her fault, it's always the same on ebay, due to the issue with counterfeit goods and the postal service.

Why the hell should she be having a character assasination when that's the way it is, and that's what she asked for, not people ripping her whole character to shreds. She asked how to deal with the cost of getting her postage back, people then said she should not return anyway.

This place amazes me sometimes.

Thats just getting value for money...ie the money you paid for your internet :whistling:..Kidding all illegal downloads are not right and are the cause of the loss of jobs to the average Joe and their businesses and not forgetting the right to make overly paid superstars even richer so that they can live a life being tax exiles.

OP just report the seller, he misled you in to buying a fake item when he knew it was not authentic. At least if you do use Demonoid etc you know that you are getting a fake item. The difference between the two is being knowledgeable to the provenance of the item.
