http://news.sky.com/story/sir-philip-green-makes-conditional-offer-to-plug-bhs-pension-hole-10554303

"Sir Philip Green is seeking assurances that regulators will abandon a probe into‎ BHS's vast pension deficit if he makes a "voluntary" financial contribution to the retirement pots of thousands of the collapsed chain's former employees.

The subject has arisen during discussions between the two sides, sources indicated this weekend."

I look forward to the slander letters...

...The tycoon promised to "sort" the deficit when he appeared before MPs in June, although he has since been criticised by parliamentarians over the lack of visible progress...

...Referring to its anti-avoidance investigation, the regulator's spokesman said: "Our anti-avoidance investigation continues and our chief executive has given a clear commitment that we will have made significant progress by the end of 2016.
---

Still some months to go, but the Pensions Regulator seems confident a resolution will be reached.

Sad sad world that if you are a Joe Bloggs employee and you are caught stealing a bit of office stationary at work you'll lose your job and possibly be convicted or if you are an habitual offender or career criminal for small crimes you'll get a few months of Her Majesty's pleasure and court costs

But steal millions using "legal processes" and you can still enjoy your freedom on the luxuries gained from your "legal processes" but the Joe Bloggs you screwed over still have to try to survive.

Justice! Justice! what does that mean?

Forget the fact of misappropriate of pension money which means BHS was actually trading as insolvent at the time. Which is not only a criminal offence but also the Directors can be held personally responsible.

Forget the fact of misappropriate of pension money which means BHS was actually trading as insolvent at the time. Which is not only a criminal offence but also the Directors can be held personally responsible.

It may breach provisions (below) of the Insolvency Act 1986, but is not automatically a criminal offence.

Directors (or singular, if only one exists) of a Company may be personally liable for the Company’s business liabilities & be fined, prosecuted or disqualified as a Company Director if the rules within the Memorandum & Articles of Association are not followed.

Any limited company trading insolvent without acknowledging to creditors it is trading insolvent is a criminal offence & directors are liable.

May be liable.

The association between insolvency & liability is not automatic or an assured fact without further tests.
