Dredded eBay advice

I bought some tongs / hair wand from a business sellor. They come in different sizes so bought two the problem I have is I have another more expensive set that curls the hair alot better and gets hotter than these. I emailed the sellor to let him know they were not very good and that I wanted a refund. He emailed back they would accept them back but if they found no fault they would be returned to me no refund. They don't work as well as the other pair. Is there anything else I can do what are my rights?

so both sets you bought are rubbish? is that right? I'm a tad confused lol.. you bought 2 new pairs but have a decent expensive pair?
But it sounds like they do do the job just not as well the more expensive pair which to be honest you would expect
Thanks the reason I bought 3 in total and as stated in my first post they are diiferent sizes so create different curls my daughter dances so we use them for her. Thanks tinkerbell so can I request a refund from the sellor under the DSR as I would prefer my money back and pay extra fir the more expensive pair that's does work. Thanx again

This is a short guide to Distance Selling Regulations (DSR) and eBay

DSR's do not apply to real world auctions however, trading standards and the DTI do NOT class eBay as auctions regardless of it being called an online auction. Therefore if you are a business you are liable to abide by DSR's and ensure you are running your business legally. Visit the eBay for business guide

The DSR's do not apply to private sellers, so for those of you that sell unwanted items as opposed to buying to sell you are not legally obliged to abide by the DSR's. You do not have to offer returns or a 7 day cooling off period

As a private seller you need to decide whether you wish to offer returns and/or exchanges

Trading Standards are well aware of eBay and the business legalities

The only cases in which the Regulations don't apply are:

* Businesses selling financial services.
* Sales of land or buildings.
* Purchases from a vending machine or automated commercial premises.
* The use of a public payphone to buy or sell goods.
* Rental agreements that have to be in writing, such as a long-term lease on a property.
* Auctions, including Internet auctions.

4. So the Distance Selling Regulations don't apply to auctions. You're currently trading on eBay. Are you exempt?

Yes, at the moment, online auctions such as eBay, Ubid and so on are not affected by the Regulations - provided, that is, that you're allowing consumers to bid for your goods. However, if you use the 'buy now' function on eBay (as many small businesses do), this sale is not part of an auction and therefore DOES fall under the remit of the Regulations - so watch out.
If you are within the timeframe to return them don't forget to send them back trackable,either signed for recorded OR Special delivery dependant upon the cost,anything over 36 pounds should go SD:thumbsup:

I agree if you change your mind or the item is faulty yes but because they aren't as good as more expensive ones is not the sellers fault and will not be returned as unused
Isn't DSR returned in the same condition as you bought them? I.E. New, sealed and unused
