hi if an ebay payment is refunded because the buyer did not recieve the item, and now you have found out by royal mail that the item was recieved and it was royal mails fault for not updating tracking information and the buyer wont pay what should you do??? its been over the amount of time so a dispute cannot be opened.

yeah, paypal cant do anything because it has been refunded and ebay is only option on monday morning when i phone them

its not on there and will never be. i phoned them as i wanted to claim back the cost for the item that was sent. and they said its been delivered but royal mails mistake it has not been put onto tracking system online. they have sent to my email proof of reciept and a copy of the signature on they day

oh rite, i was goin to say phone them and explain. there useless unless u actually phone and speak to someone to explain properly whats happened, same with ebay lol :)

Well it's not just RM's fault is it? Judging by your op it's a dishonest buyer who new this so put a claim in and is now refusing to pay?

Raise it with ebay so they are aware of the buyer, but yes small claims would be your only chance really.


yes because it was being tracked and they did not update the system saying it was recieved by the reciever. and yes also it is a dishonest buyer too

Basically op rm, won't actually do anything they won't entertain a claim for the item as A it was delivered and B, what you have is consequential loss, a financial loss because of their delay, it's not covered under recorded.

The buyer s/he is the one that has made a fraudulent claim, your claim is with them. I would take it to small claims if it were me, how much was it for? I would also report it to the police and let them know you are doing so.

I doubt pp, will do much as you have no online proof, you can but try though and it will be a noted against the buyer.


rather not say price. i have proof on email from rm. proof of the signature that they used to sign for it

Therefore if it's a huge loss to you, I would be taking it to small claims. RM will not pay out as the most they owe you really is the delivery charge at a push as they failed with the tracking, they actually delivered your item and can prove it.

Now the fact paypal refunded as they did not update thier systems properly, is neither here nor there, that's not directly down to RM, it was paypal as a CONSEQUENCE of RM's mistake, it's what would be classed as consequential loss. Which special delivery covers, for example they loose/delay the item and it in anyway causes you direct financial loss.

Your claim is with the buyer and I think it's £35 now, which you would get back, if you have their address, I would take it to court, but that's just me.


thanks for your help, im not annoyed with rm. they have not updated a tracking number a couple of times before. rm doesnt bother me they told me it was recieved. the buyers the problem

I would make a claim just out of principal even if it was a tenner

Before threatening the buyer with the police and legal action you need the RM to investigate it 1st and make sure you have a copy of the signature. You need absolute proof it was delvered 1st to the buyer or you could end up with egg on your face.

I would claim it.

The same thing happened to me when I sent a heavy item to the US.

The parcel took 6 weeks to get there and Paypal refunded the buyer in the meantime.

The buyer emailed me to let me know they had received the item but never paid me back :x
