HI I have sold a phone on ebay, the payment was held in my paypal account, and now the paypal say only way to get the money is if the buyer leaves positve feedback or there is no dispute within 21 days,

I tried explaning this to the buyer and now he has filed the dispute and he has emailed me saying he going to leave neqative feedback as he thought i was lieing,

I want to send the phone but will i receive the payment which is currently being held

i will post throu special delivery and will have tracking number will this help

why on earth did you alert the customer to this, you are supposed to send the item it is paypal holding your funds, not the customer, the customer would not have even known, and no you will not get the money untill feedback has been left

Yes send the phone, payment is being held so that the buyer has time to file a dispute. Its because its such a large amount and your new i expect.

make sure your seller protected though.

to be honest. i wouldn't leave positive feedback until after i have received an item and it is as described etc. I have heard of paypal doing this to some people though i've never experianced it myself. So i am not sure what exactly provokes it.

op paypal now do this alot on many transactions, it is to cover paypal, if people empty their accounts of money then paypal have to cover the loss, buyers do not know the money is on hold, as far as they are concerned they have paid and awaiting item

it happens to me everytime i sell, its because the star rating u get when a buyer leaves feedback are below 4.5 out of 5. when u get pos feedback paypal release the money with a day, or if u havent had feedback within 21 days they release the funds. it's a bit of a pain but theres no way around it and you do always get ur payment

The seller has to send the item when the money has cleared into paypal, not when they get positive feedback. I wouldn't leave positive feedback until after I have received an item and it is as described etc.

thanks for all you advice, but the thing is he has told me he will leave negative feedback and he has already filed a dispute with paypal, so the both terms that would of got me my money cleared have been against me.

the buyer has to leave positive feedback or not file a dispute within 21 days.

does anyone know if i would get the funds once i have sent the phone, obviously if i have the tracking number to prove i have sent it?

He is leaving negative and opening a dispute because you haven't sent the phone yet and he thinks you are just making excuses. Look at it from the buyers point of view he has paid for an item and you aren't sending it. I'd do exactly tbhe same thing if someone didn't send out an item I'd paid for.

Your problem is with paypal not the buyer. Let him know you got confused because paypal didn't transfer the fees and apologise and ask them not to raise a dispute as your going to send the phone. Then once they receive phone you can get the funds

TBH, now I would not even bother sending it, if you have annoyed the buyer that much, it's even more hassle.
If he has opened an INR, then yes you would get the money released to you when your proved delivery via tracking.
If I were you explain what you meant apologise and ask if he still wants it sent.

the transaction only occured 2 days ago, the buyer is being arrogant, will not reply to emails, and when he does, he's always trying to accuse me of being a scammer, i have 69 feedback 100%.

i understand from his point of view, i would be doing the same probably but within 2 days, and one of them days being a sunday.

if i get my money after i have sent it then i am happy, he can leave me negativfe feedback, can't do anything about that now.

i don't mindthe neg, i just want to be assured that i will get my money if i send the phone, as you guys must already know, its a high value good.

i can't afford to lose the phone not get the held funds.

yes he has escalated the claim, i don't really want to forget about the sale as i have been charged nearly £20 on ebay fees, and when i asked to cancel the transaction (as i was getting all mouth from him and he filed a dispute) he rejected to cancel the transaction ebay, so i lose my final value fee of nearly £20

tinkerbell i have said sorry to this guy about the misunderstanding but he just won't accept it, i am unsure if he still wantsd the phone or not, i am totally baffled, i would really like to get on with the transaction as i have stated above i have been charged nearly £20 in final value fees

Yeah but if he is annoyed, which he is, he thinks he has been ripped off, he could be vindictive and change the dispute to a SNAD, he could under these circumstances, bust your phone just for the hell of it.
As you would get the funds released on proof of delivery however if he then says the phone turned up broken..............
The buyer is not being arrogant, he just thought you were scamming asking for pos fb before he had the item. If it were me I would apologise, explain the system and see what he wants too do. Does he still want the phone or refund, honestly if it were me I would refund,which you can do yourself through pp as it's not at the claim stage.

Yeah you can do it would help, nothing for him to say it was not trashed in the post, it would help no guarantees.
Honestly though he sounds really hacked off and won't agree to a mutual, so I would not bother you will probably end up with more hassle than what it's worth IMO.


i think you are correct, oh by the way its not been escalated as yet, still at dispute stage, i have also contacted paypal and will se what they have to say,

I know u have said ur guna refund but just read below for future reference

how much feedback have u got in the last month???

my funds were getting held a while ago, when i was sellin phones on there, but as soon as i reached 10 feedback in 1 month they would not get held. It doesnt matter what feedback score you have altogether, its what u have in the month, u could go on there an sell stuff then a month later ur feedback for the month were in now would be 0.

Always make sure u send recorded or special delivery as i had a experience where the buyer claimed they had not recieved the item only to find out they then sold it on there account.

Its not really worth all the trouble in asking them to release funds. As like u just experienced they can be funny c**ts.

That's totally incorrect, there are many way in which the determine holds, Fb in general, if it's minus 100, dsr's, seller performance, time with ebay, amount of transactions.
If you are under a 100 they can hold the money whenever they see fit, no guarantees at all.


PayPal will not hold payments for eBay items if you meet the following criteria:
•You have been an eBay member for more than 6-months, and
•Your total Feedback score is greater than 100, and
•Fewer than 5% of your transactions result in dissatisfied buyers*
Or
•Your average DSR is greater than 4.5, and
•Your have received more than 20 DSRs in the last 12 months
•Your buyer dissatisfaction percentage is less than 5%





Yeah i understand all that above as thats the process it goes through, but what i was tryna say is that when i got over 10 positive feedback in my first month the funds were not getting held but when i had less than 10 feedback in the 2nd month they would get held. (only been a member of it for like 3 months)

I wasnt tryna say it happens all the time as i have just sold something on there and they have been held once again. lol.
