ebay - buyer selling it elsewhere when i have done a buy it now

can they do this? I did buy it now and mailed them about collecting at the weekend. Had the confirmation that i had bought this at 8.41. now at 9.24 she tells me that shes had someone round to look at it and they have left a deposit so its been sold!
Ive mailed back saying that its a bit off and i entered into a contract with them through ebay and that it wasnt listed as being advertised elsewhere and for them to fulfill the contract. where do i stand? probably nowhere but any advice gratefully received.
p.s it was a car if that matters

Yeah, they are contractually obliged to sell you the car if I remember correctly

You're not allowed to put "advertised elsewhere" in your listing anymore, i had a listing removed just yesterday for this very reason.

I have messaged the seller quoting the rules and regulations and messaged ebay with a copy of the message the seller sent me - whether it will do me the slightest bit of good is another matter. but if nothing else it gets it off my chest. Im really miffed - been looking for one of these for ages and was really chuffed id found one!

People make a big song & dance about Ebay being a 'contract' but the only people EVER legally covered on Ebay is Ebay themselves....

As someone said, neg 'em, explain why in their feedback & move on.

I wouldn't let the matter die without at least taking advice from your local Trading Standards department, if only to find out where you stand legally.

Similar thing happened to me although I was the seller, it turns out that I sold the item - someone came and picked it up and then someone bought it on ebay before I had a chance to remove it.

I guess with your case it was deliberate rather than accidental - it all depends on what it is, it would probably be easier to get it from someone else than to go through all that hassle, at the end of the day the seller does not have the item anymore so Trading Standards can't force them to send it.

I would still leave appropriate feedback because it was deliberate and not accidental.

HURRAH!!!!!!!!
After an email from eBay and a (polite) message left on her answerphone I have received a call from the brother explaining the mix up and then a call from the seller saying she was very sorry and that the car was now mine! I may have been hasty in my reaction or maybe because I was quick off the mark the situation has been resolved to mutual satisfaction!!!!
