Hi guys, just wondering what you think of this situation.

I bought this bike (http://****/is12QW) and collect it with cash payment on Wednesday. I rode it home, and realised the 3rd gear doesn't work - i.e. the hub is faulty. The seller did not mention this in the listing or on collection. I have tried emailing and calling the seller to no avail, even though he has been online at least twice today to list new items. I'm only after the money to fit a new hub, so am I in the wrong here and how should I proceed?

I'm presuming you live close to the seller so am not sure why you didn't return to see him/her as soon as you realised the bike was faulty.

As it stands, the seller could claim that you caused the fault.

Regardless, I'd pop around there to see them to discuss.

ride it back to his shop/home and ask him to sort it? It is possible that he did not notice that there was an ebay message waiting for him.

because I felt it to be serious enough - he didn't inform me on collection so I felt this to be totally dishonest... do you disagree?

I think u should open a case with ebay and paypal against it, they will give him some days to sort out if he doesnt then paypal will return ur money. If he is a new seller money is with paypal

I lost my relaigh blue colour bike few mths ago, if i had to sell it i would give a whole detail so that there would be no dispute, open a dispute mate

Paypal? It was cash on collection by the looks of things so paypal won't give two hoots.
I would not have negged after 4 days, I would have given the seller a few more days to sort it out, and consider going back to his place and asking him to fix it (it appears as if he sells a few bikes so he might know how to, or have a replacement bike).
Now you have negged him I doubt there is much incentive for him to get it sorted tbh, and you might have pee'd him off. Not good when you want a resolution to something and when you didn't use paypal.
Good luck, contact eBay anyway, and I hope you get it sorted.

As you have neg'ed him without giving him enough time to resolve the issue, do you really think he will want to help you ??

Okay, maybe I was a bit quick to neg, but thank you guys nonetheless - I've opened a dispute with eBay

IMO you have handled this very badly OP, I'd be suprised if you get anything now you have negged them.

You can also request his telephone number via eBay if you haven't already got that?

So is it actually the hub thats knackered or is it a simple adjustment? I notice its a sturmey archer 3 speed and they are well known (to us oldies at least) for being a bit of a bitch to get spot on.

not good, you could report him to ebay for saying cash only and get his auctions pulled to get back at him a little
how much is it going to cost to repair?

I've tried adjusting and all I've managed is to get 2nd to stay on when I turn it to third... The small chain also seems to be too slack

Also it'll cost at least £40 to get a new hub plus the trouble of fitting it

I'd suggest emailing the guy saying you will get eBay to retract the negative feedback if he will resolve the issue, and apologise for leaving it hastily etc. Leave it in ebays hands then, they'll sort it for you.

anyway, a new hub wont make any difference. It needs the cable adjusting.

as you have now admitted to adjusting it, ebay will rule in sellers favour.

No problem with cash on collection only, i never accept paypal on a collection too easy to be scammed

Oh I know,. but offering paypal in the listing then in the text saying cash on collection only is against ebay rules, so the listings will get pulled if reported

If that were true then just about every car listing would be cancelled. They all offer paypal but I think it highly unlikely any of them would actually accept it. That was a very poorly thought out decision by ebay.

Cars is one of the categories which is an exception to that rule.

The gear linkage requires very fine adjustment, the OP has messed around with the linkage, so no come back on the seller.

All I've done is turn the small screw-on ring... it's now back in its original position.
