Ebay - fake item, should I return or issue a snad?

Hope someone can help.

I won a buy it now, some expensive Vibram Five Finger shoes. The seller had 100% feedback and was UK based. However, the shoes are fakes. I didn't know it at the time, but apparently there are more fake vibram five fingers than real ones on ebay. They are everywhere.



The seller has a return policy, but if I return them, he has my money and the shoes and can carry on selling fakes.

Or should I issue a "Not as described", and tell ebay they are fake?

My worries is that ebay will ask me to prove they are fake, which will be impossible - no Vibram dealers near me.

It should be down to the seller to prove they are genuine, not me!

Would really appreciate some advise.

I had this issue with ebay a few weeks ago as they thought i was buying Fake Ugg boots blah blah so i couldnt buy them through ebay

Anyway if it was me i would report it and go into a dispute and once you have the money back i take it you paid through PP then return the goods....

There is more fake than genuine on Ebay nowadays i noticed and when im looking online for stuff and see fake ugg boots i report them because i dont want innocent people getting ripped off

If you are 100% sure they are fake then you should be able to prove so so give it a try ;)

Some people have said that when you claim an item is fake they want proof from a 3rd party. I'm not going to be able to get that.

I can't prove it. I know they are fake, but knowing and proving are two different things.

Surely the people on that website you linked to will be able to help you prove it

One of the people on there mentioned the tongue colour. Email the manufacturer and they will tell you

8) give the seller 2 fingers for their 5 finger shoes and demand a full refund

This was the sellers response when told about the fake shoes:

Hello.
Thank you for contacting us about this issue. We are amazed at what you have discovered with your investigation into the Fivefingers Speed version. We noticed this before with white polyamide covering at the base of the tongue with the Vibram logo embroidered, in fact we had these in stock. We questioned the sales rep about this and he told us that one was an earlier version than the other.
As you have discovered, this seems to be a grey area with regards to the stock photos of the Speed version on the official Vibram websites, many of them show the Speed without the polyamide covering at the base and it is something that Vibram should address.

As in our Terms and Conditions we offer a full refund on any item up to 14 days when the item has been returned to us. So please be sure that we shall issue you with a full refund for your purchase, we will also refund you the shipping cost to have them returned back to us because of this situation.
At present we do not have any more of the Speed in stock and we are very anxious for you to return them to us so we can investigate this counterfeit grey area with the sales rep who will be calling with us on Thursday 17th March. We really want to get to the bottom of this because it would be detrimental for our reputation as we run 2 bricks and mortar footwear shops and service 12 outdoor expedition centres across the country.
We sincerely apologise to you for what has happened and fully appreciate you being pro-active with your research with this issue, but have complete confidence that we shall fully refund you with shipping costs on return of this item.

It all sounds above board, but I don't think I trust a word of it. Still not sure what's best, send it back for a refund or file a 'SNAD' and claim fake. Has anyone done this recently? What proof was needed?

I hear what you are saying, but these fakes these days are very hard to tell apart at first glance. A couple of months later, when they are falling apart, you know.

The seller is not an authorised stockist (confirmed via uk distributer), there are spelling errors on the shoes, and they look different. more info here

they sound genuine just send them back and get a refund ,

I'd be tempted to just return for the refund, as they are paying postage. But it is illegal to send fake goods through the post.....

So how much did you pay for them and how much are they normally?

If you know their fake then you can't return them via royal mail, That's illegal. If you can't prove they are fake then I'd just request a refund.

I paid £85. They retail for £100, but are hard to come by, especially in my size. They were brand new, so I thought OK, why not. If I had known that there were so many fakes about I wouldn't have bothered. Live and learn.

Apparantly, eBay have changed thir policy and it's up to the seller to now prove an item is not fake.

If that's the case I'd do that, so he can't keep selling fakes, but it would be nice if I had some confirmation of this. Ebay wouldn't say over the phone, just told me to take out a 'SNAD'.
