Need desperate help, I sold my projector on ebay. Worked fine before I sent it. Turned it on, took pictures etc.. Packaged up, even put fragile sticker on it. Guy recieves projector, claims that its broken and wants his money back. After a few messages sent, I said i'd send him the Post office receipt and I asked him to close the eBay claim incase he takes the £400 off of me then £400 off the post office.. He said he didn't want to do that and wants to send the projector back to me, and wants his £400 back. The thing is my gran just passed away and I have to pay a lot towards her funeral costs and do not have £400 spare.
PayPal also has my balance at -£400 and I can't buy anything from eBay until I replace the £400
What should I do? I don't want to put the claim into eBays hand's incase they side with the buyer, because I really do not have £400 at all.

Ebay do side on the buyer alot, how did you send the item special delivery? insurance claim?

Its your responsibility to ensure the goods get to him in good condition

You have to claim from royal mail not him

Refund him once he has returned the item then claim from Royal Mail if you can

Put yourself in his shoes,how would you feel if you received something broken in the mail

this same thing happened to me... i got so pee'd of with it all that i'm never going to use ebay or paypall again.. paypall put my account into negative and threatened to send the bailiffs round. Ebay side with scammers and shiisters that change their mind after receiving the item... hopefully there will be a new auction site that will come to the forefront and give fleabay some competition

Sorry to hear about this but why would you send him the Post Office receipt?


Don't send him the receipt that's your proof, if you have to send him something a photocopy or via email, but why would you?

its up to the seller to prove to paypal/ebay it wasn't,he can't

OP do check serial numbers when it is returned in case he is trying to swap a faulty item for yours

How do we know it was not? I am just saying, I have bought items in the past that was treated roughly by the delivery company. so I guess its up to royalmail to pay up provided the seller insured the item..

do the pictures you took of the projector when it was on and working on happen to have a date on them? if so would ebay/paypal accept them as proof of it working.

does the projector have a seriel number etc n that you made a note of incase the buyer is trying to pull a fast one by sending you their old same make faulty projecter (Could happen)

Make sure that you keep the receipt! Only thing that you can really do is ask for the item back and then give a refund.. Try and stay on the buyers good side cos they'l have to fill out a form if you claim.. Did you send it speical delivery?

he has the refund already.from reading the op........... so i would make sure you get the projector back and then make a claim with royal mail......for your sake i hope you took out adequate insurance

if you have insurance then put a claim in with royal mail and provide print outs of the paypal claim and details that it was damaged along with evidence of the refund

do check its the same projector that is returned also:)

It was in good working condition when i sent it, it was well packaged and bubble wrapped.

I have pictures of the projector turned on in the day i sent it with the date on it with a piece of paper

I didn't take note of the serial no, didn't think this was gonna happen to be honest i packaged it so well didnt think much could have went wrong. i guess a fragile sticker goes for nothing these days with the rm

yes it was insured with rm for £400, so glad i took the insurance

I have proof that it was working the day I sent it. I also have proof of insurance. This £400 is the least of my worries, if I had the £400 I would refund the buyer but I do not have £400

Right and it's fair the buyer is £400 out of pocket is it? You won't be out of pocket when you have claimed on the insurance which it is your responsibilty to do.You won't have a choice paypal will refund for you, gah some people!

What, I have said the way it is, you are going to have to claim and be £400 down until you get the insurance to pay out, the end.

say he sends the projector to me right; my paypal will still be the same ? (-400)
i claim from rm (around 3-4 weeks maybe longer to claim, if i'm wrong?)
if the claim is successful i get the 400 and put it into my paypal and thats everything?

you are not £400 out of pocket and a projector down. You are a projector down. You have it insured so where is the problem? Get the item back and claim simple as that.

youve clearly withdrawn the money from paypal or it wouldnt be showing minus.........now you need to pay it back in

unless youve spent it........

they wont just take it from your account anyway its up to you to pay it or youll get county court letters affecting your credit score eventually

have you spent the £400 already before the buyer got the projector safely?


it should still be in you PP account in case of such claims,if so you will have to paypal then get the claim money or they will send the debt to a collection agency

You have received member opinion, it's not always going to be favourable.


As mentioned, it's your responsibility to ensure goods get to your buyer. Insurance is for you, not the other party.

Do insist that the buyer agrees to provide you with assistance in your claim.

that is the process.....but obviously they check what other claims have been made from your address also

Not so good if that's the case. Unsure of how long the buyer has to raise a claim regarding SNAD, hence your understandable concern.

However that's the risk you take and perhaps unaware that you could be subsequently stung.

I have claimed for a damaged item that the buyer received, it was sent recorded and all they gave was a book of stamps and apologised.

The only time i have received a full refund is when the item got lost.

they have started sending out declarations to the other party involved as well and asking them to be signed and returned to confirm item is missing or ben damaged, these are getting more and more frequent so its best to try to sort it out amicabily or else you can face extra delays in them investigating

Personally I think you are being scammed,the reason for this is if I had sold something on Ebay and then 3 weeks later the buyer says it's damaged I would be very wary.You should ask him why he waited 3 weeks to inform you of the damage and also make sure Ebay realises that 3 weeks had passed before you were informed. But to be honest with you as other users have stated if the worst thing happens you can allways claim on the insurance through Royal Mail........Good luck.

I no longer accept paypal for anything expensive on ebay, far too many scammers, I won't post either, it's cash on collection only, that way both you and the buyer can see the item in working order before money changes hands, also they cant take it home break it and file a claim. Only safe way to trade IMO.
