Hi Guys.

wondering if anyone could give me advice on a problem I'm having with ebay.

A month or so ago I bought a spoiler for my car which was titled "Astra Coupe boot spoiler, yr 2000+". The spoiler arrived and it's not for my car at all. When I hold it against the boot it's at least 2foot short and doesn't have stalks to mount it on. My best guess is its for a corsa lip spoiler or something similar. I contacted the seller ( who has 150 + positive feedback). She told me she'd sold it for her Brother, he was away on business so I should relist it myself and sell it on. I refused to do this, mainly for the fact I had no idea what car it was for, and didn't want to con someone else how I had been. I sent her pictures, and eventually gave her a time limit to respond to me by or I'd report her to ebay. She ignored my request so I reported her. Ebay have now told me that they can't do anything as I paid by cash ( stupid I know but I posted cash recorded delivery). However, the seller marked it as payment recived and this isn't the dispute.
Ebay have advised me to go to the Police. Again, I emailed the seller telling her this, and that I didn't want to go to the Police as it was a waste of their time, although if she didn't refund me I would be left with no option. I've been ignored again ( all over £40, but for me it's the principle thatI've been conned).
Ebay say they can do nothing about it, but surely there must be some repercussion for an ebay member incorrectly describing items, as surely this is fraud.
Any help or suggestions would be greatly appreciated.

Hi Helen,

If I remember correctly, you are a seller on ebay as well, aren't you, so you aren't an inexperienced ebayer. What possessed you to send CASH? By doing that you have lost all ebay protection.

Anyway,
Your options are, as I see them, would be to send the seller a letter by Recorded or Special Delivery informing them that they have 7 days to refund you and arrange collection of the widget or you will take them to the Small Claims Court.

Or, see this as a expensive lesson and drop it. Try and find out what the widget is really for and sell it yourself on ebay but describe it correctly.

Soz, but that's all I can think of. Sending cash has stumped you I'm afraid. Don't blame ebay, blame yourself.

Yup as Dinosteveus said, never EVER send cash for ebay transactions. Although you've probably already tried it You can go through the "Item Not Received or Significantly Not as Described Process" here....

Although you have made a mistake by paying with cash (did you send the cash recorded? That may help if you need to take legal action) You may still be able to open a dispute as the item you received was not what was advertised.... I guess that is all you can try really before, as Steve said, you threaten with legal action.

Dinosteveus is the expert though- I'm a 616 feedback novice compared to him :)

Further on with this story..

Ebay refused to help me, and said I needed to report it to the Police for Fraud. I contacted the seller to tell her this, and said obviously I didn't want to but if she refused to refund me I would have little choice ( She ignored me again). I'm waiting to see what happens with the Police, but asked ebay what action they're taking and they said non as there is no proof ( Even though I've offered to provide pictures, email correspondence etc etc!!) I left negative feedback for the selle saying " Badly described goods and this has led to police involvement- Buyers Beware". she has now left me negative saying I'm a liar and will try to con people!!!

I've contacted ebay but they refuse to remove this negative feedback, and said the only way it can be taken off is if I see a solicitior ( Which will incur charges) and have them write a summons for libel. To me this is completely ridiculous and I can't believe ebay allow people to behave in this way, but wondered if anyone had any further ideas to get the feedback off that won't cost me any more money?

You can't remove feedback from Ebay, and Ebay will refuse to do so. For all they know, you COULD be a liar, and she could be the one in the right, not you. You can only approach someone to mutually withdraw feedback.
