Hi

Bought a PS3 Slim 12gb for £120 brand new.
Now I was amazed at the bargain initially and was cautious.
The woman selling seemed fair with over 200 feedback etc.

They story is I paid for the item straight away at the end of september.

It still hasnt come and the lady says she is too ill to send it.
I have offered to drive and pick it up.

After me messaging and trying to get somewhere she finally says that she will refund me, no refund as of yet.

I offered to wait til she was feeling better but she was adamant she will refund me.

I rekon she has sold it for more money myself.

but is there anything i can do??!!!

I think you have up to 45 days to complain to ebay so do it straight away to get your money back

Go through the Ebay Resolution centre ASAP - you may just be within the 45 days period in which Paypal will help you.

same scam happened to me they will say they were in a serious crash and will say i will send like in the next 2 weeks than you wait two weeks than they wil say something back and wait until 40 days are up so you cant claim your money back through paypal and they usually delete there account off ebay. BE warned!!! Doesnt matter what feedback they have..

As above, if its gone past the 40 / 45 day rule, you have no chance of getting your refund.

Get her address, jump in the car and say you will collect it. (Say to her you will come pick it up at anytime.) then you will know for sure if she says she's not free anytime.

ebay is full of scammer's coming upto xmas.

Hope you paid with paypal? if so get a claim in asap, paypal do favour the buyer usually, they will ask for the seller to provide proof of postage in the way of a tracking number if she cant provide that paypal will refund. Put a claim into ebay as well to make doubly sure, good luck

Spot on, why on earth have you left it until it's probably too late to put a claim in (if you do). illness or not you should have raised a claim as soon as it didn't arrive after 2 weeks.

request her details from ebay you can get these from your my ebay page at the top of the page where the help and contact us is and they will email them to you immediately.it may have there phone number listed ive done this before when ive had some off messages and its funny how they change there tone when your on the phone lol.
but tbh i cannot believe you have left it this long.

You state the end of Sept, what date was the purchase ??, because even if at best if it was the last date in sept your on deadline day.

From and including: Thursday, 30 September 2010
To, but not including : Monday, 15 November 2010

It is 46 days from the start date to the end date, but not including the end date

As already mentioned you only have 45 days to raise a complaint, best get a dispute raised with Paypal or ebay quickly otherwise you'd be on your own and the woman will know this, Also use the request sellers contact details. With both of these either they will send the item or promptly refund you.

ebay is good for buying things were you can go and collect and pay cash for.. or really cheap things... ie.. PS3 games for a fiver...

When spending anything over £40 I always look for other options.

There's nothing wrong with using Ebay as long as you have common sense,some people are far too trusting unfortunately.

If the OP paid by credit card the card provider will have some power to intervene such as a charge back, these can take place well after the 45 limit

Good point - Hopefully the OP will be able to get money back using that route...

PayPal seem to try to prevent this by making you register a bank account; but I always make sure I pay using my credit card.
