Ebay help please?

Hi, I sold a 360 on ebay that i had fixed with the x-clamp fix and the buyer emailed saying that it was freezing and wanted a replacement. He sent the 360 back and when i received it i noticed a loose washer inside the box. I opened the console and i noticed that he had opened it because there was a screw missing, 2 washers missing and he used white thermal paste, i used arctic silver 5. What i want to know is could i open a dispute with paypal and say that i never received it in the same condition that i sent it? Thanks for any help.

yeah i should think so after all if you returned something to a shop, in that condition, having opened and messed. Tyhen you wouldnt get your money back or replacement. Hes messed and bust it.

probley wouldnt work because ebay always takes the buyers side but worth ago, was the the item sent back using a signed for service??/

I had a similar problem. A buyer bought a box set of DVDs and had them for two weeks. He complained to PayPal that they were all scratched (which they were not when I sent them as they were brand new). He returned them to me and they looked like he had rubbed all of the (6 DVDs) with wire wool. PayPal paid him back the money despite my offering proof that the set was new. I doubt if you will win either.

tell the buyer you are contacting the police about it, most of these people give up once you mention police to them

Thats really bad....there are so many scammers on ebay.

I might just tell the buyer that i'm not going to replace the console because he tampered with the first one and just give him a full refund. Has anyone got any advise as to what i should do next?

why not play him at his own game and send the console back to him via tracked so you can prove to paypal you sent a *replacement*? :whistling:

you wont get in trouble with ebay as its your right-i would email him say you are reporting it today as you took pics before it was sent, so can show its condition. Are you sure its yours?

i doubt it, he's the one in the wrong anyway. or like suggested send it back to him.

You won't get into trouble becaue it's not an idle threat, you have every right to report any case of lawbreaking. As dataload says; most scammers back down when you tell them you will take things further.
Edit; plumberman's suggestion of saying you took pics prior to sending is good too

then he would still have to send it back to you again under a 'not as described' dispute which he would have to pay for again, would be suprised if he would fork out for the courier cost AGAIN :)

I had one lady told me she had a damaged item and named 3 faults then when i questioned each fault they vanished til she had one fault(she said glue on the item but it was the type that just comes off as its dripped in manufacturing)-i knew she was chancing a part refund so i asked her to return it and i never heard another thing...not even a neg. Call his bluff?

See what he says? Paypal dont make you refund the buyers return postage costs, thats why he will probably think twice about having to send it back to you AGAIN as he wont get that back so he will be even more out of pocket.

I was considering a part refund.....what would be a reasonable amount to offer. He paid £50 incl delivery. I emailed paypal and this is the email they sent me.

I have reviewed your account and I can advise you that on the 20/11/09 you
received a payment for £50.00 from buyer****** This payment
has completed and the transaction has not been refunded to the buyer. I can
advise you that with PayPal if you are sending a customer out a new item
that you refund the original payment and they send you a new payment before
you send them a replacement. The reason for this is on PayPal if the buyer
has an issue with an item we ask them to open up a buyer dispute, if the
dispute is found in there favour and they return the item they are only
then refunded. If the item you receive back is then different as is the
case here you can appeal the decision with PayPal. As no buyer dispute has
been opened however we cannot follow this process.

I would advise you to try and communicate with the buyer directly in
relation to this issue.

This is not a partial refund scam, otherwise he would not have sent it back, so don't partial refund as he can just open a dispute for the whole amount. Is it your console he sent back?

Help please....the buyer has just asked why i haven't sent the replacement. I don't want to send him a replacement because he tampered with the last one and i don't want to give him a full refund. What should i do?

You can refuse outright to exchange it and see if he takes it to dispute argue your point, he may not if he knows, you know it's been tampered with, it's what I would do.

i know but what can you do i agree its B******* Look if you don't mind a bit of agg then go with paypal/ebay to sort it out. Have you asked him about the opening it up ? Is it the same console serial number ?

Yeh it's the same serial number. I've just received an email from him....

Oh dont worry about that. i have a custom halo edition case which went on as soon as i got it. the bolts on the bottom you added have just been tightened to save the time of sending you the console back because of the freezing issue. All should be in order though? I dont understand the problem.?

so he has just admitted to tampering with it. send it back to him and if he does a dispute send a copy of the email to paypal. he damaged it whilst transferring the casing :)
