Issue a refund. Claim from the post office with your proof of postage and ebay listing details.
#2
you refund them and put a claim into royal mail

Yes, you will lose i'm afraid. Refund and claim off Royal Mail will be the only option.

Tell them that they'll (unfortunately) have to wait 15 working days for RM to accept it as a loss, then send a claim form to RM claim your money back then refund. If they open a claim then refund them at the latest possible date. RM deliveries are taking ages in some places at the mo, due to xmas and strikes :)

(next time send recorded!) ;)

To be honest though, sometimes it makes no difference! I once had a recorded del parcel (some nice make up!) just posted with the normal post!

Makes no odds, rm will refund you with a proof of postage as long as you send paypal invoice to prove value and address sent to. I have done this a few times and always received a cheque back.

i sent a pair of £35 jeans recorded once and they got lost and royal mail still didnt refund me so looks like im gna lose out yet again
#16
If you posted on 11th September they the deadline has passed for them to make a claim against you.
#17
@ sameena, Not if you sent it normal post, RM will try and wriggle out of it by claiming you are trying to fiddle your postage cost by not paying for the correct service, why would you send something of such value with no insurance?

Sellers claim has to be made within 45 days. If you sold the item on 11th sept then they should have made a claim by 26th October.

If they haven't made a claim they are too late.

From ebay

If the seller hasn't made things right, contact us so that we can help. You can open a case 3 days after the estimated delivery date of an item or 7 days after of making payment if you weren't given an estimated delivery date. A case has to be submitted within 45 days from the date of payment.

Yep more than passed.

Put a claim in with Post Office. if they refund you then do the decent thing and refund the seller.

But the deadline for them making a claim has passed.
#22
that a bit cheeky, they did send you a message after a week that they hadnt got it.

Thing is even recorded is bull! I sent an item recorded delivery, it just kept saying on tracking that it was being sorted, and i rung CS and they said it seems it has been lost by royal mail, therefore put a claim in, in which i did, along with my recorded delivery and receipt for the goods, and recieved a letter back stating that they had tried to contact the company to see if they had recieved it but could not get hold of the company, therefore they asked ME to get in touch with the company, otherwise my claim will be closed in x amount of days!!!! Fuming was not the word. I sent a lengthy letter explaining the company had disappeared of the face of the earth and no telephone number for them anymore, therefore i couldnt get in touch with them and that i had paid for a service especially to cover myself and that they had a right to issue me my money!!! But before i got a response the company then sent me an email stating they had recieved the goods and were refunding me, but still royal mail were out of order!

oh well im over it now..ive sent in all the paper work etc so if they pay out it's a bonus... i've always sent 1st class normal & nothings got lost, so i just posted it like i posted all the rest of my parcels, anyway lesson learnt, just lucky it wasn't a great deal more than it was..

id photocopied my reciepts and everything and submitted them to the post office, they were useless about the lost parcel, tbh the person hasnt botherd to contact me for two months which i believe shows how little they care, i would have refunded if the following week after the first they said they hadnt got it, just seems a riddic time to wait....

If you didn't send it by a recorded method then say bye to your money. Thats why I always use rec delivery when dealing on here!

Royal mail once refused me, i sold smething for about £49 sent it normal proof of posting, Seller claims didnt get it (seems to happen a lot that)

I went to RM, claimed the £39 plus what i paid to post, first they said no we will not be refunding...i wrote back telling them as i had paid for the service, the service had not provided what i paid for and i expected my money, i had lost out for their mistake. I also asked for a reason

Second letter arrived...i had originally provided them with an ebay number and a copy of the paypal reciept...their excuse was they cant look it up on ebay...and they could not actually cost the item, i argued that regardless of this i still paid and used this service, weather it was an ebay item and that it was not up to me nor them to prove the worth etc, i had to refund the amount due to their incompetance and they should refund me...They then sent me a cheque

I have the same problem but i sent a ps3 game to Malta and they are saying they not had it, I only sent it by airmail so im being told on here i probably want be able to claim because i cant track it.
