ebay help - will i be scammed? update page 3

Hi all, in need of some advice.

i won a phone on ebay, the seller had labelled the phone up wrong, header said it was storm 1 but main body said storm 2. so i got a bit of a bargain, about £50 less than it should have been.

he's tried to sell the phone before but buyer said he didnt send phone, and he did get a full refund.

anyway i asked for postage details to send a cheque and he just sent me an address and no name, his contact is pretty poor, i get a message reply but it's usually a day later. i've given him my email and also my phone number, neither of which he's used, yet his ad said he's got a new iphone.

he also has (-1) feedback due to the prevoius attempt at a sale of this phone.

now if i use paypal and this lad doesn't send it what are the chances of me getting my money back?

i'm a good few hundred miles away so it's not as if i can pick it up either!

anyone got any advice?

use paypal dont send a cheque you should get a refund if he doesnt send it and you use paypal but if you pay with a cheque you have no chance.

so how do you know which it is? is it a bargain if its a storm 1 or 2, my crystal ball aint working today hence why im asking

I wouldn't bother, something that looks a scam usually is, what's to stop him taking your money then closing his ebay account?

Paypal can sometimes be a real pain to get money back but a cheque fto a possible scammer will be gone for good.
Always check feedback before placing a bid and errors on the page can sometimes be a scammer giveaway especially when English is not their native language as they do not really7 know what they are selling in the first place.

he listed the phone as a "blackberry storom 9530" which is actually the storm 1 but the picture is of a storm 2 and it says it's a storm 2 in the description.

i had absolutely no intention of paying by cheque, i just want his full name and address just in case he decides to screw me over then i'd have issues with driving the few hundred miles to collect my money and compensation.

if i pay by paypal can he shut his account down and i wont get my money back?

if he sends anything about the same weight recorded delivery it will be his word against yours, its anyones guess where paypal will go

He can empty his paypal account so that if you have to put in a dispute and you win you still wouldnt get the funds. Paypal are a bit useless when it comes to disputes. I have a felling he has just randomly put together a listing which he knows will make him dodgy money. I may eb wrong but I have been scammed once for a phone on Ebay so never again.

i would never buy a phone off ebay, or sell one, only have to say its stolen 2 months down the line and you knackered

usually if it says local pick up then it would indicate its ok, so it's up to you really.

Maybe it is just a series of unfortunate events.

Don't do it.

As mentioned by others, if he screws you over - cashing the money out of his account quickly and never sending the phone then you won't get anything back from a dispute.

Paypal does offer some protection, but I'd never rely on it fully as you are. Their dispute system is not perfect.

Agree with that, but on the other hand if he was a scammer he'd have scammed the first buyer. Personally i think he just another ebay idiot, not a scammer.

well as we dont know how it went we cant really say, maybe buyer put in immediate paypal dispute, or by reading the description maybe he refunded the paypal because he knew paypal would refund, and wanted a non refundable payment method, his feedback says the phone doesnt belong to him, yet his description says it does, unless of course he has come back from the dead

Incorrect infor here, if you pay via the auction, via ebay YOU WILL recievce 100% refund from payapl even if the seller does not have funds. TBH that seller will probably have a hold put on his funds, which is why I expect he refunded the last buyer.............

So although you are covered, I still don't know why you bid with his fb and the fact he seems to tell porkies, too much hassle!

I think what sassie is trying to say is that you have noticed his poor feedback and the incorrect description yet you are still interested. Most would walk away but you see it as an opportunity. Just two different opinions.

He probably thought ohhhhhhhhhhhh what paypal have held my funds until the buyer is happy and left positive fb, so he refused to "send" and refunded, just my guess.

Hi there I am selling my Blackberry Storm 2 as I managed to convince the Mrs to get me an iPhone for Xmas, the phone is in mint condition and only 3 weeks old I got it as an upgrade on vodaphone. It comes boxed and with all the software charger and cables. It also comes with a pay as you go sim card which I bought separately for the new user. If you have any questions regarding the phone please give me an email, if you want to have a chat leave your number and I will give you a call or vice versa. I will be sending it recorded delivery however the winner is more than welcome to come and pick it up :) Happy Bidding. I'm sorry about the PayPal its just I think it is best for both parties as it is a secure method.

his poor feedback relates to this phone and he gave a reason why, i'd be very surprised if he made up losing his brother as an excuse.

as for incorrect description, his first line states its a storm 2 which is also known as a 9520, the storm 1 is known as a 9500 OR a 9530, he's listed his as a 9530 assuming the highest number = latest phone, or thats how i saw it.

so i dont see it as all black and white, though i did see it as an opportunity!, thanks for the explanation :)

i actually missed that it was his brother phone, i thought he was saying his brother died and thats why phone didnt get sent out.

You obviously have serious doubts so why entertain it? As previously stated above, if it looks and sounds like a scam then it probably is.

Maybe the image showing a better model than he is meant to be selling is the hook to get you so interested that you will proceed even if it looks a bit ropey? He is looking for someone who can't resist a bargain!!

LOL are you serious????????/ That is the biggest load of tosh going on ebay, so and so dies, so and so is ill, so and so is in hospital.

He has refused to send it gave a full refund saying he couldn't sell it as so and so had died but then relisted and if you read the 2 listings, the 1st one the phone is his not his brothers, so he is lying.

My guess is paypal held his funds, so he thought oh wait, can't get away with this so refunded to try again. OP that's why he had so many bidders people fall for a sob story.

you see this is where i disagree, the image is quite low res/black, it's hard to tell its a storm 2 unless you know what to look for and his main listing text was saying its a storm 1!

i'm going to give it a miss though.

Is this the only phone of this type on ebay? Look elsewhere surely - I can see it ending in tears and lots of 'I told you so'!!??!!

:oops:yes i was being serious, i dont use ebay that much, and the thought of people lying about losing a brother to make a few quid would never enter my mind!

He has actually sold the same phone[COLOR="Red"] 5[/COLOR] times since Jan, which makes it increasingly likely, he has no intention of selling it, probably as he is hoping for paypal to release the funds instantly, he has got no hope :lol:

unless you call me to get this sorted by tonight on ****** i'll have to withdraw my bid. your replies are taking too long and this coupled with the problems with the last sale are not helping to convince me this sale is all above board.

you state you recieved the phone as an upgrade yet in the feeedback you then state it was your brother's phone who has passed away.

i want to give you the benefit of the doubt, but it's obviously a lot of money. give me a call so we can get this sorted. or text and i will call you back.

It was my brothers phone who passed away, that was his listing I just relisted it. I have been patient in waiting for your payment, I didnt want a cheque I wanted paypal, who would of held the funds until you recieved the phone. I have sold this phone so far 9 times to liars and time wasters. If you wanted it paypal it and I will send it recorded delivery, the bad feedback is due to a hustler from Nigeria, well thats where he wanted the phone sent, I am in dispute with the feedback he sent me already. The listing in all fairness I did not change from what my brother wrote, if you dont have the cash just say so and there will be no hard feelings. Just been messed about so much for a phone, I am the executer of my brothers estate and am selling posessions on his behalf. The phone was indeed an upgrade and I will send you the receipt too.
Paypal or nothing I'm afraid, that gives us both piece of mind!

SO he let his brother use his ebay accoutn now did he lol.

The neg guy won't appreciate being called a nigerian scammer no doubt, that looks like a buying account, for someone who is in the business of mobile phone/refubs, and very active it is too and well maintained. If it were a nigerian scammer he would have been shut down ages ago!

I would never have bid in the first place, but then it's your choice what to do now.

Oh and an after thought............if it's an upgrade and it's therefore a contract, if his brother is really dead, then the contact will be terminated, which means as the phone is still in the contract period, then the network could request it back, or just brick it.

As when you taake out a contract/upgrade if you don't fufill the contract period for whatever reason the network brick it.

The moral of the story,don't buy expensive items on Ebay when you're not au fait with it,especially from a seller with little or no feedback,or in this case minus feedback.

Common sense should prevail.:thumbsup:
