Ebay Help - Yet Again !!

Hi peeps,

Ok so my purchase of a laptop for my other halfs 40th has this morning turned a little bit sour. I purchased off ebay (200151318889) what was described as a Dell 1300 with 512meg of ram and a 15.4 widescreen display. He msg'd me a couple of times on Tuesday and said would send the item special delivery and it was an excellent buy, in brilliant condition like new. Anyway this morning it turned up and i feel a little bit peeved !

What i have in front of me is a Dell 1300... but with 256ram and a 14" widescreen display. To be honest the display is so faint that in a miniscule but of sun i cant make out what is on screen and its soo bloody grubby that i can tell what the guy had for dinner over the past year, even after a clean. So i am not a happy bunny.

Ok i am going to email him about selling the item that was not correctly described and try to reclaim my money. He sent it special delivery and it totalled £20 and it had buyer protection for £150 but i paid £170. What then would be the best course of action. I have yet to leave feedback, yet to post a dispute claim, yet to do anything really until i know what im getting into. The missus's birthday is on 11/10 and i really could do with the cash before then... if any !

How long does it usually take with something like this for ebay to sort out if he gets funny. Also in regards to sending it back to him... will i get lumbered with the £20 return postage or do paypal sort this out aswell.

Gawd i wish i got a new one now, but money is tight atm and i could really do without this before a 40th birthday :-(

Any1 got any advice that could in some ways cheer me up ?

Probably make a Paypal claim - the item came not as described. I have never used this option so I dont know how it will pan out.

But wait for somone like Dino to give you some advice.


Also, you should never buy anything expensive on ebay from somone with that little feedback.


Edit: wait - you should contact the seller first though.

Yeah i would wait to see what the seller says, you never know he might be able to resolve it, otherwise you can make a valid paypal claim as it was significantly not as described. Paypal, if you win will refund you the full amount but you will have to post it back to him yourself i think.

But maybe dino can correct me if im wrong

I would phone this guy up. Looking at his previous listings I'd say he got a bit confused with the Specs. Are you sure it's only 14"?
How much would it cost you to 'sort' it? I'm thinking it would be a lot easier for you if you asked for a partial refund because he's not had much luck selling this.

As for a dispute, I'd wait and speak to him first.
Was the Paypal payment funded by a Credit Card?

Also for a laptop thats supposed to be a 1.73ghz with 512ram check this:

Clearly 256ram with only a 1.60ghz processor. To be honest dinosteveus i just would rather get a refund on this. Its not really what he made it out to be and im a little bit peeved. Would now much rather go buy new and forget about this one. I specifically wanted 15.4 wxga as its for watching dvds and stuff. If i wanted 14" i would have found one cheaper.

Also i my paypal is backed up via a debit card not a credit card.

Maybe the seller didnt know the specs so looked on the dell website or something expecting them all to be the same. Just a thought.

I dont mind that, if he did get confused i can understand. However i bid on this in regard to the specs but did not get what i bid on. Surely im entitled to question that and get my money back ?

If i purchased a car from a garage i wouldnt expect to get delivered a bicycle ;-)

Ummmmm, I'm a bit baffled by the specs. This is the item number for first time he tried to sell a Laptop on ebay:- 200145265379, Then:-200145693657, Then:-200145864734 and now you. I'm guessing it's the same machine but the specs have 'changed' along the way. He's been a bit unlucky with scammers, I hope he got all his fees back, if not it must be costing him a fair bit.
Anyway,
I would speak to him first, see what he offers. If ebay/Paypal get involved you will have to pay the P&P to return it and this will not be refunded, but if you can agree something with him then you might be able to blag the P&P back.
Do you know how to 'pull' his contact details?

I understand how you feel and I'd be mad as hell,l but I'd have looked into his selling history before bidding on it and asked clear questions before I bid.
Having said that, it IS his fault for misleading you but mistakes happen.

I do forgive any1 for being a little bit technophobic... but on the other hand i paid £170 for something that is not... and now it looks like im gonna be stuck with another £20 to return the item. If it was as described then i wouldnt have a problem. Shame coz this present means a lot to me so it has to be what i wanted in the first place :-/

Edit: sorry steve i dont really know about how to look at previous selling history. I just look at feedback and base things on that. Lesson learnt.

In a way I feel sorry for the guy, I mean he left you feedback straight away, which left him wide open for a Neg, he's been hit by scammers quite a few times and he lives in Wales. Hehehe, Nah, just joking about living in Wales.

If he, and im not saying he will, but if hes some student that decides to not refund me as hes already blown the cash on beer or ladies of the night... shuts down his ebay account and then his paypal account... because of the ebay buyer protection will i still get my money back ??

And yeah he does seem an ok guy. He msg'd me straight away and gave me feedback instantly. He does seem a little nieve, but hes most probs an ok guy that just doesnt know what hes doing.

Have now sent him a msg to ask him to contact me on my home phone. Will wait and see... hopefully he logs onto ebay a lot.

It takes 180 days to close your Paypal Account.
I'm not sure how long for ebay, it must be over 45 because you have 45 days to make a claim via ebay.
If he does not refund you and ebay/Paypal have to then they will close his ebay account. Fat lot of good that will do cos he could open another one but he won't be able to use that Paypal Account and opening another Paypal account ain't as simple as opening another ebay account. Phew.

I would see how it goes on the phone, you may come to an amicable agreement if he can't pay you in full. Have your mind open when you speak to him, if you know what I mean. How much of a rush are you for the money? Would you be able to sell the Laptop? If he offered you £70 compensation and you sold it for £100, just an idea.

raise an ebay , item not discrisbed despture, u will get told to list what wrong, he wil get a chance to repsond, if he dosnt offer a selution, ebay will make him refund you and return ot

Ok so some sort of resolve today.The guy phoned me from work and i told him what was wrong and told him i wanted a refund... seconds later the phone went dead. I done a 1471 and then phoned back his mobile, noone picked up so i left a msg. In the meantime i sent him an email explaining what was wrong with photos like the above and while doing so i got one in my inbox reading:

'Dear squelds,

Im an internet seller, wih that in mind the phone call isn't really relevant here. I can issue a refund to you if you send the item back to me.

Ok so he has offered the refund which im pleased about... but ffs is it too much to ask for someone to be polite and helpful nowadays. To say a phone call isnt relevant really pee'd me off to be honest lol. If i make a muck up and a buyer had a problem id only be too happy to help over the phone. Anyways i suppose i should be grateful that ill get the refund so quickly. HOPEFULLY he wont be a pain in the a*s and say something is wrong on return lol !! Oh and btw no mention of him paying the return postage !!

What do you guys recon about feedback then. I do feel he just didnt know what he was selling in regards to specs.. however can i really give him positive, and with the abruptness of the msg back about the phone call i feel like he should be trying his hardest to sort this out NOT ME !! I feel you should neg him as this is one of the cases which it should be done, i got neg feedback years ago because the buyer was a well lets say not very pleasant.

If it was me, I'd start a Dispute with ebay/Paypal.
It's okay sending it back but what then? You will not be able to make him refund you.
I was hoping he'd be more amicable, but it doesn't sound like it.
Leave the Feedback until you have been refunded.

MyEbay/Dispute Console/Report an Item Not Received or Not as Described

When i enter the item number it says not until 21September

Eh ive tried several times now... is it something im missing or what lol ?

EDIT: OK so now have opened a Paypal dispute... ebay cannot be opened until the passing of 10 days if im reading it correctly.

2nd EDIT: OK so even if i send it back to him now he still might not pay. By opening the dispute what does that mean - he has 20 days to pay or else ?

I don't understand why you cannot open a dispute for Item Not As Described.
As for the Paypal dispute, Paypal will contact him and let him comment. If he agrees that it's not as described Paypal will instruct you to return it by a trackable service and pass on the tracking number to them. They will then either refund you or expect him to.

Coz item not received and not as described are under the same click within ebay. Once i click it it says to wait 10days.

As for paypal he hasnt replied within paypal yet but he has sent me email saying no worries just return the item for refund. LOL he even said 'ill still leave positive feedback for you anyway' - i dont think he has much of a clue !

Shall i wait to be instructed via paypal or just get it off... the pain in the bum is that he recons hes away on business till Friday. Ahh well.

PS Dino i also got this hehe:

'Hiya buddy, i have no problems with refunding you, but i dont appreciate the paypal dispute when you said you would not open one, now my account is in - figures so it seems i will have to pay twice.'

This is where it could get complicated, the safest way for you to get a full refund is to let it go through Paypal. This could take two weeks though.
Do you feel that you can trust this guy to refund you if you just send it back? This would be the quickest way to resolve it. If not, leave it to paypal.

Send it through a courier and you should be able to get the price below a tenner. IMO he should pay anyway but you can't force him to. He might be more willing to pay a tenner tho?

Just to update that ive taken a chance and sent it back to him yesterday special delivery. At least if he kicks off id be covered for £500 and it gives me piece of mind. The more i communicate the more i get a bad feeling... perhaps he will prove me wrong. Anyways he has already relisted the item before he even got this one back !

Just to update that ive taken a chance and sent it back to him yesterday special delivery. At least if he kicks off id be covered for £500 and it gives me piece of mind. The more i communicate the more i get a bad feeling... perhaps he will prove me wrong. Anyways he has already relisted the item before he even got this one back !

Anyway he bank transfered the money Saturday and cleared this morning into my acc. So thanx for all those who helped me yet again... appreciate the advice :-)

Could be a couple of reasons why he could not refund you, never mind now, it's not your problems.

That could explain the paypal problems, have you cancelled the dispute?
I would be expecting your P&P back from him before I'd close it.
If he refunds it, I'd leave a positive, if not a neutral. At least you had a refund, so a neg is a bit drastic.
Strange chap, I think he has learnt a lesson by all of this.

Yeah all closed now.. and im not gonna push for the return postage, mainly coz i dont think id get it. He doesnt seem to be very clued up and like you say i hope hes learned his lesson from this for the future. He seemed genuine enough, just a bit nieve about ebay etiquette (if there is such a thing nowadays).

Youy could've carried on with the dispute and got double the money back! Obviously keeping it all would've been wrong but keeping £20 for the return p&p and giving the rest back would be what I would've done. That basically forces him to pay for the return p&p, don't think he could really have argued with that.

Ummmm, let's see where this goes.:roll:
You cannot refund a refund so how would the OP refund the seller?
If he sent the money back as a 'send money' option the seller would have to pay fees at 3.4% and 20p on that transaction, so he would get less.
If the seller contacted Paypal with a Bank Statement to prove he had already refunded the OP then Paypal would close the OP's Account, well after freezing it for 180 days.
All in all, not a good idea.:roll:
