Following on from my thread the other day in regards to an ebay query...

Item was sent and received today...now they are claiming the item (a ring) is a fake.
I am amazed that considering he said he is very busy etc but he didnt sign for the item until 12:45 and he has already had time to check the item and go and get it tested...although obviously I can't say that he hasn't, as it is possible.

However, it was tested by a local jewelers before it was sold! He is saying that unless he gets a refund by tonight he will go to the police and trading standards (not sure what they can do to help him anyway).

A message has been sent stating for the item to be returned to be tested (again) before any refund...but no reply.
Is that not fair or not? Also he seems to be trying to deal with everything over the phone and not via ebay/paypal which seems funny to me as well, as then nothing is ever in writing as proof...

Any ideas guys? The item was over £150 worth...

Just get him to send it back....and then refund,bloke is clearly a tool or a scammer....check he does not send you back a dodgy one

Ignore usual toothless threats,refund upon receipt of returned item or they can go swivel is the correct thing to do

Be sure he puts in a paypal claim now,or he could do it again after you refund....

ask him to take it to a jeweller to get it tested, if he refuses say you will refund but just delay the whole process.

It is sometimes easier for people to be pressured over the phone, stick to emails in my opinion. I always refuse to negotiate over the phone.

That is what I thought personally, he has set his feedback and whatnot to private as well which I've only just noticed. Just was checking that paypal aren't going to be idiots about it and refund him without the item being returned as such. As if he gets a refund he doesn't have to return it and there is little relief. Whereas if the item is returned even if he is worried no refund will be given he can claim via paypal.

doesnt he have to show proof of it being fake, well he would have to if he put in a paypal dispute, what does he mean by fake, like you have said its solid gold and it isnt

yeah in the voice message he left he stated "refund me" not he will put a claim in for a refund. Didn't realise they could do that!

Well he reckons he has already from only receiving the item about 4 hours ago, yet the phone call a few days ago he stated he worked 8am-6pm and would be working today but would arrange for someone to be there to sign for it!

TBH, I wouldn't have even sent it, it was obvious from his attitude he was going to cause issues.

He would have to get proof it's fake..........Just tell him you have independant proof from a jewellers it's genuine, if he wants a refund, he is to return it, no arguments.

When you get the parcel, most posties will do this, open the parcel infront of the postie as a witness. If he send a dud back, it's more help for you.

Yeah it was a solid gold ring, my Mum took it to a local jewelers to get it checked and said it was gold. He is stating it has been tested and 'it turned green, and its magnetic'.

soundsexactly like a buyer i had a few years ago, i sold a 1 crt diamond 18ct gold ring for £200 they signed for it at lunch time and within 2 hours had it tested etc and demanding a refund, they didnt even want to send the ring back. after months of arguing paypal found for them and i received a ring back, not the one i sent either! i was gutted.police didnt want to know nor did paypal or ebay.

Argh hope it doesnt happen here! That money is my Mums and she was buying me a washer drier for my new apartment when I move in with it!

AGHH, see what he says, just ignore him for nowm if he opens a SNAD, refund upon return, you need to be careful what you get back.

Yeah same...although I've got photos of the item and its not the most normal ring as such as its fairly heavy and an odd measurement of what you normally get, got photos of the measurements as well.

And I was thinking of selling my PC on ebay if it doesnt sell on here...I defo won't be now!

if you have photos, just make sure you open infront of the delivery man.

If you are going to sell your PC on ebay just do it cash on collection. Never had a problem with that apart from people not turning up.

i would tell him that if he is not happy with the ring, he should put a claim into paypal for a refund. Tell him you are willing to give him a refund but that you expect him to return the ring with proof that it is fake otherwise you will not refund his money, and tell him all future contact must be made through paypal and not on telephone. If he is dodgy he will probably not bother and if he says he is contacting the police tell him thats ok too, im sure that have better things to do that deal with this person.

Well I have contacted ebay and stated what has happened so far, hopefully they then open a dispute if wanted by the buyer and he can return the item for a refund.

but how are you going to prove that is or isnt the ring he sent back, its gonna be one of those your word against his, he will say you swapped it, you will say he did

And yet another problem I know :cry:
Even getting the postmans information (if he doesnt mind) and opening it in front of him is not of much use, even if i take my laptop to the door to show him the photos of the ring i sent as well.

Yeah but jewelery isnt always the easiest thing to sell, and if I had put collection only would have got hardly any bids.
Just so annoyed over it, well won't be using ebay in the future to sell anything unless its cash on collection I know that now!

ring has been checked by local jeweller and an acid test has been done,this test failed,it allso sticks to a magnet.gold is no magnnectic!.you did not provide your return adress on you special delivery enverlope.please provide your full postal adress so i can return your receipt that i will get from trading standards tomorow morning.i will also be informing the police first thing tomorow.i have been buying gold for some years now and had a few fakes in the past,most ocasions they have been sold to me with the seller not realising they were fake.this is 100% not 18ct gold or any gold whatsoever.trading standards will issue me with a receipt for the ring and i will post this to you as soon as you provide me with your postal adress.please do this through ebay so they have a record of this.my number is .regards richard

have you got paper proof that states it is real. ie when you checked its authenticity, if so throw that in his face.

how the hell do you know the ring he has had checked is the same ring you sent, i dont know to advise, other than to get in with paypal first, and say you want the ring returning, also remove his number from your post

Nope as in all the years ive had rings tested they just tell you, I suppose if you got it valued/appraised then you would have some paperwork but that also costs money.
Even if so it could be from another ring.

Don't get into a drawn out conversation...ignore all threats.....ask him to open a claim through paypal and state that you will refund on receipt of ring.....

Inform him that any further contact with him must be through paypal and you will not respond otherwise

When i was in India and wanted a ring checked out the only way they could do it was by acid,but then it ruins the ring.I took that as it melts its. I would check with a jeweler if they did a acid test what happens to the ring.
Good luck to you and the other person having trouble with selling a Tv on Ebay.

Just read this........ if it is really gold. The best way to see if it is real karat gold is to have it tested. That means an acid test or a test using one of the newer electronic gold testers some jewelers use. That is what I would recommend.

Ok cheers again that is what ive done. I've informed paypal and ebay of the problem, and stated to him that i shall refund once a paypal dispute is opened and the ring is returned to my possession, and that i shall only communicate through paypal now.

When I got it tested I believe they just did a scratch test...but could be wrong.

Is the buyer within reasonable distance of yourself or family? Collect the ring .... that way they couldn't give you a 'dodgy' ring back.

Good Luck. Sometimes ebay really is such a hassle.
