Further to my posts about selling a vtech smile pocket with toy story 2 being bought by a vtech dealer who complained it wasn't bright enough - i left the dispute to customer services to conclude.

They concluded NEITHER me or seller at fault but gave her a full refund. but haven't asked her to return my goods?????? So now she is listing toy story 2??? Is this not taking the Pi$$??????

Why does that matter?

If you have written confirmation of what you put in the OP from ebay I'd consider taking action. I'm usually not the sort of person to jump on the legal action band wagon but that sounds really unfair to the point its robbery

They haven't listed the console yet but they listed the same game they day the case was closed.

I've appealed asking for the things to be returned. The didn't find in favour of her so don't see why i'm out of pocket.

Really wrong given she is a vtech dealer and if you check her feedback for others there are quite a few negatives where she has claimed the goods are faulty.

Must be onto a right winner buying and selling just off ebay and getting your money back on any you dont htink you can profit from :-(

buy itback from her then put in a claim in it doesnt work lol some people on ebay are selfish and ebay/paypal dont help when they side with them all the time so they basically give them the go ahead to try and rip people off.

Maybe it's worth calling Consumer Direct and seeing if they can give you any advice about where you stand?

Thanks. Just seems unfair! And i get negative feedback from her claiming it was faulty and she won! Not technically correct!

I did but they can then comment back so she gets he final say. Argghhhhhh all this for £10 kids console with game!!

Ebay can be so unfair, I bought gloves on it and they were in terrible condition. I then have to pay to return them leaving me out of pocket for sellers fault.
I feel your pain.

Similar thing happened to me. Sold a used vtech console, had to pay more postage than what buyer paid, those consoles are heavy. Buyer found a small thing and said I hadn't mentioned in the listing.....it doesn't affect the use of the console. He won't take partial refund and wanted full refund including return postage otherwise he said he'll give neg. feedback. Seeing the sale price and postage being close, I refunded him in FULL and asked him to keep the item as well. ....I lost about £20 but hey ho. He has now emailed that I HAVE to pay return postage and take the item back cos he can't keep it as he hadn't paid for it! Its a fully working and in excellent condition Vtech console and its free for him!!

exactly the reason i dont really use ebay now ,haven for conmen i was a powerseller now lucky if ive sold 10 itemsi n 2 years

I sold my xbox 360 on eBay and 5 weeks later the seller put in a claim fot it being faulty, it had never missed a beat in the year I had it. To cut a long story short they ruled in their favour and asked them to return it. They never replied to a single email I or eBay sent them or return the goods so I got my money back but due to it putting my paypal
account into debit vowed never to sell anything on eBay again. Classifieds on here and a certain other Audio Video forum are far better. Your case seems unfair and for 10quid it might just be better written off to experience. I don't get eBays stance on wholly protecting the buyer when the seller shares equal risk.

The money is irrelevant in this case but it puts me off selling anything on their just because you're so at risk of being out of pocket no matter how well you list an item/ what condition.

Some people clearly lack morals!

Yeah, the way I have seen no faults work is ebay/pp take the hit so no-one is out of pocket, the buyer does not have to return at their cost, seller does not loose out on postage.

The way op words it is different.

I would have asked them to return for full refund, they have to pay for return even if they went through paypal/ebay. If they are odd you will end up with neg anyway, might as well make them pay for it:x

Ah I see, I thought the OP missed out on the payment for the item due to the refund. In that case the OP just wants thir cake and eat it. You got your payment so stop complaining and get over it

I told him that but he said I have to pay for the return postage or else neg. Many buyers like them use neg. feedback powers to blackmail.

Hmmmmm nothing to see on pay pal yet???? Maybe i got it wrong. just presumed that meant they took it from my paypal?????

I've didn't even know that existed. If i had i would have been quite happy with the outcome bar the negative ffedback she left.

Certainly not me trying to pull a fast one just ebay never explained and it's my first dispute.......

I didn't know paypal/ebay will foot the bill on nobodys-fault!
