I purchased an item from ebay.co.uk from a seller in Australia, transaction was in us dollars. The seller provided me with a tracking number and a link to the Aus post website where I could trace it. On the website the tracking number was not valid so I contacted the seller as i was worried. I had no reply and no item so i opened a dispute and escalated to a claim when i still had no reply.

Last week the claim was closed in the sellers favour. I spoke to a claim agent on the phone and they said that because the seller is in Australia he only has to provide proof of posting and that I could appeal the claim but was unlikely to win as this was ebays policy in that country.

I said what about my protection as a buyer in the uk and basically all they kept quoting was the above about the seller only has to provide proof of posting not proof of delivery as we have to in this country. Was also advised that this is also true for sellers in Germany too. The seller has contacted me since I left negative feedback - complaining about it and that I hadn't contacted them!!


Where do I stand now? I can see nothing in ebay or paypals buyer protection that states you are not covered if you buy from a foreign seller on ebay.co.uk. I can appreciate the requirements for sellers are different in different countries but surely the buyer protection remains as this transaction was made through a uk website. Surely uk law must prevail here?

In theory any seller from germany or australia can provide any old number as a proof of posting and ebay/paypal wil accept it.

Any advice on what I can do now would be appreciated. I have emailed paypal twice to ask them to show me where it states i am not protected but guess what have had no reply.

Thanks for the headsup! Did you pay from your funds in your pp account or did it come from your credit card? Might be able to do a chargeback if the latter.

Both - will persue the credit card chargeback but unfortunately that was only £48. Will in future make sure I withdraw all my funds so purchases are paid for by cc

Be careful that way as well as CC have caught on to chargebacks on Paypal and often refuse now as the money goes to Paypal it's seen as transaction complete and they'll tell you to take it up with Paypal whose service you used.

It's all just a giant fiddle now.

they might try to tell you that but thats to stop you claiming.
The money doesn't go to paypal, it goes to the person you have sent it to.

I would read Buyers Protection again, and also your user agreement, as paypal like to hide things in there,

Without reading into these schemes, i would guess that regardless of what the sellers requirements are for sellers protection, this should not override yoru buyer protection, provided you have met all the requirements.

If you believe that is the case, you can appeal against the decision in paypal

Thats good to hear and only fair. Lets hope others don't get done and lose out for the same thing.
