ebay/paypal question

Ok here goes,

i bought a pair of jeans off ebay and there was some wear on them that was not describel in the description and no picture was taken of it either.

The seller finally offered me a refund but less £5 for his costs (which isnt including postage of £5) so I would be over £10 down due to this as well as sending the item back cost,

So i went back to him and said I wasnt happy with the offer and wanted a full refund and he came back and said he wouldnt offer any refund due to my persistent asking for more, I only asked for a full refund so i couldnt understand his point there.

So i raised a dispute with paypal and now he has come back to me and said he will give me a full refund if i return the item and he inspects it himself and is satisfied that the item was not as described, if he thinks the item is as described he said he will send the jeans back.

Now i have done everything by the book and I know he will just send the jeans back due to his present attitude. If i do that will I still be covered by my paypal dispute?

What would other people do in this situation???

I just want my money back, I understand that i will not recover postage and accept that I will have to bear the cost of return postage, but due to the way this guy is behaving I am reluctant to follow his command.

How does a paypal dispute work? after I have lodged it is this acceptable response????

Paypal disputes have pretty much always favoured the buyer over the seller!

Was the item advertised used or new? I would open a dispute via ebay rather than paypal as the item is not as described.
Give them a ring. Take photos of the item, areas where damaged etc

i have tried that already but he is insisting the item is as described

so if the item is in dispute in paypal, what else do i have to do, or just wait for the seller to offer refund

you will need to take pics of the items, make sure you get a photo similair to how it looks on ebay, then take another of the damage, return the jeans, im assuming you have opened a dispute with paypal, once returned send the tracking number on to paypal via the dispute

i had to send some boots back a couple of weeks ago because they were not as described and ended up over £12 down but there was nothing paypal would do for me, they said they would only refund the amount i actually paid for the item

the problem is below the left rear pocket, which isnt pictured at all, the denim has started to go and the white of the cotton can be seen, this isnt from the style of jeand as he has ssuggested either

if i send it back do i risk of getting the item back from the seller saying he thinks its acceptable

so you would suggest taking photos and return the item?

i think your going to struggle with this one, as they are used and wouldnt really expect no wear, i think you will return them and he will refund what you paid for them, minus postage costs, but you will need to dispute this with paypal dont think he gonna do it of his own accord, paypal will usually side with the buyer but you just never know

You paid £36 for that load of old tat, I have thrown away jeans in better condition than that.:?

personally think the description vintage and adding that there is fraying should be enough to tell you they wont be immaculate. I think at best you get your refund price you paid and i really dont blame him being funny about it. Thats unless the damage is severe.

You need to return the jeans via recorded or special delivery, if you don't the seller can say he never received them. Once you have proof of delivery input the details into paypal and THEY will refund you your original purchase price inc. P&P.
