I bought an item off ebay that in the condition was adertised as Used, but in the description the person has stated that they've only put it as used because it doesn't have tags and in actual fact it is has never been used.
But when I received it is blatantly obvious that it is very used. For one, it has four dead batteries in it (it's an item that wouldn't have come with batteries) and it is cosmetically damaged, with significant scratches and stuff.
I've put in a paypal dispute but his answer was simply that he stated the condition as used.
Are paypal likely to resolve in my favour? What do you reckon?

Paypal dont care the always side with the buyer.

Even if they do, you will have to bear the costs of returning the item to the seller.

No damage mentioned. The condition said used in the bits you select when selling an item, but in the description, he's stated that it has never been used.

Yep, just had a email from the claim centre, saying that I have to pay to post it back and to track the item. It's not even worth very much, it's just the seller was really rude and agressive and tried to be intimidating.

Keep it simple.

Bin the item and leave negative feedback, but please be tactful and to the point, otherwise the seller may be able to get eBay to remove the feedback later.

A decent seller would pay for the return postage BUT if they have tried to pass it off as new when the item clearly isn't it you've got no chance by the sounds of it!

If you didn't pay much for it and you're likely to end up out of pocket on return postage then don't bother, leave a neg and leave a one for each of the stars.

Yep thinks that what I'll do.
He's been really agressive and horrible too, saying I've tried this antic before and I'm getting myself a reputation. But I've got 100% feedback and have never had any major problems before. I think he's just trying to intimidate me. what an ahole!

i sent someone a game and they said it had no disc in the box, and paypal gave them their money back! i even sent it recorded and provided tracking! Useless.

I recently bought a zune 80 on ebay and it was described as new. It came without box, headphones or manuals. Just the unworking player (couldn't save or play songs) with lots of scratches. Now have a paypal claim in.

look at the listing "seller is responsible for contents of listing"

..I had the same the other day, am sending some pics of the crud I received (he claims he was unaware of, such a leaking batteries, scratches dings, paint chips etc..
seller says he was unaware & will reverse the paypal payment.
we'll see

Although truth in what you say I am kinda stuck. I have about 60gb worth of audio files (and loads of video) and if I want to play them on a portable player I have a choice of:
1.Ipod classic (itunes and sound quality.....bleh)
2. Zune (against ipod classic has a slight lead)
3. Cowon a3 or 02 (both great but expensive)
4. Archos (too expensive and had bad experience with 605wifi and hate the pay plugins)

Got to say though ebay/paypal are becoming a scammers paradise (both for buyers and sellers), for that reason I tend to stick to only pick up only items or long standing traders with over 99% positive.

As for selling, got quite a bit of stuff to sell but am put off by the fact that its so easy for a buyer to claim INR (even with recorded delivery sometimes) or even easier a SNAD claim, paypal would tell them to send back via recorded/tracked and they just send a similarly weighted box back, as soon as paypal see its been returned they refund.

I had a lovely 100% feedback until someone did this to me, what I cant believe though is that it was a £10 item they did it on, I've sold items costing £100's no problems, even shipped one item to Germany, then some scrote did it on a low value item.
