I bought Lost Planet of ebay for £x.xx, and received it today, the game came still wrapped with its secuirty sticker over the opening, however the case was cracked at the top, I contacted the seller and told him about the situation. And asked hime either to refund me enough money so I could but a new empty case, or send me an empty case.

Seller replied saying that he posted it undamaged and that I should go to the post office and get a claim form from them.

Should i be doing this or should he, I'm not blaming the seller just wondering who should be doing what?

It is the sellers responsibilty until the item arrives at your home in your hands - so you might want to take some pictures of it still sealed with the crack to prove this, and possibly with the envelope it came in, but the seller is the one who needs to claim with the post office (I think)

It's about 35p for a new case isn't it? hardly worth complaining about. Just make sure the DVD isn't scratched when you open it.

not the principle though is it realy, i buy a game which should be £39.99 new and get it for around £30, and its damaged, you do kinda feel a bit miffed off.

I've filled out a claim form though, the seller isn't realy been that helpful.

took photo's this morning for some proof of the damage.

I'd email the seller again now you have pictures, ask for 50p and get a new case. Far far far far less hassle than either of you trying to claim from the post office!!

Do you mean a royal mail claim form? Not sure they will help you.
It's like getting blood out of a stone even when you have a valid claim, but in this case you don't - but the sender might, it depends how well the Royal Mail considers it was packed, something which you paid the seller to do! ;-)

As others have said, your dispute is with the seller not the Royal Mail.

It isn't down to the buyer to fill in a P58, that's the job of the seller. He has the receipt and he posted it. He should have spent more time packing and wrapping it.
If any of my items get damaged in the post or through the courier, I know it's my fault because I did not pack it securely.

It's the case! The game is fine, the cases are around 35 like I said earlier. I think you are being a little fussy. If the DVD was damaged as a result then I'd be concerned.

I hope you get your 35p, you obviously need it. ;-)

Don't forget paypal will take their chunk (probably 5p) so best to send 40p to be on the safe side :giggle:

royal mail throw stuff around like rubbish being dumped. I used to regularly sell on ebay and took the upmost care to package well but still a few items arrived at the buyers address damaged !! its a ball ache when you have to refund something that has been broken enroute .. I too think the guy is being picky as long as the game and insert is in pristine condition i wouldn't complain

Exactly, the post office is the first place for people to moan to about damaged/missing mail. The counter clerk puts it into a sack and then the postman collects it? How exactly do the post office damage it....jump up and down and shot it across the room 15 times?!? Its royal "snail" mail that do the damaging. Also the buyer has no control over making a claim, it has to be the seller.
