I sold an item on ebay and I am refunding the buyer.
But he will only send the item back once he has had a cheque for the amount he paid.

I dont really want to refund him before he has sent the item back as he might not send it back or might damage it and I'll be left out of pocket.

he has said that if i dont refund him by 1st novemeber he will get a solicitors letter and will charge me another 38.00 for this. I just want to get it all sorted, what should i do?

stick to your guns,no goods no refund,if he goes to paypal they will make him send back any way,but whatever you do dont refund until you have goods back

if he paid via cheque he has no rights ,,,,,,, paypal would tell him if he did same, send item back then get refund ,,,,,,,,

stick to guns & tell him that....... you hold the guns in this fight :)

you wouldn't go into m & s and say "the top that i bought is faulty. i'd like my refund today but i'll drop the top back tomorrow!" if he opens a dispute with paypal, he will have to send it back to get a refund (that's if he paid by paypal). tell him that you will start charging him £38.00 a time for your solicitors letters too!

I agree with all the above. Dont send any refund until you get the item back. He's bluffing when it comes to Solicitors etc.

he paid by postal order, just worried about him getting a solictor or whatever and the costs increasing which i cant afford :o(

Don't worry about the solictor bit, doubt one would take it on. He hasn't a leg to stand on anyway.

I'm fairly sure that if someone expects a refund, they can't expect one till the item is returned. I would have thought his solicitor would tell him the same thing.

The correct thing to do in these circumstances would be for the buyer to return the item to you & then receive his refund.

its sad that these nutters are free to roam ebay and prey on people-tell him to get lost til he returns it.

I think he is scared that after he returns the item, seller might not refund. Assure him that his refund will reach him once he returns the item in original condition.
How is his feedback like?

Both of us have 100% with around 150 points each.
It's just really stressing me out as I want to just get it all sorted so I can forget about it :(

Were the goods faulty? Did you even have a returns policy?

I was under the impression that you don't even have to take a return so you're already doing him a favour? I might be wrong but have a flip through the pages on eBay which will tell you how to go about doing a refund and will back up that you never return the money till you have the item.

He sent you the money before he had the item and trusted you to dispatch, so surely it's the same deal if he returns the item to you and you refund.

If goods aren't faulty, and you don't have a returns policy just tell him that and let it be. He wants to seek legal advice let him - not going to get him anywhere, and will cost a fortune.

he paid you before you sent him the item......so he can trust you.

same way he can give the item back and then you will give him his money back. same order as last time.

update....
after saying id give him a refund once he returns the item by recorded delivery hes again replied saying that he will only send it back once he has got the money back.

he is claiming the item is faulty which im not too fussed about as i can easily repair it but he said if i dont send the money first hes going to the small claims court with a solicitor. i really dont know what to do :(

And in I pop! I have that problems on the things I sold on "another" site(the regulars know what I mean) sold 2 items one arrived bashed and one wasnt as the buyer wanted it so after an argument I resold one but the other I havent since I havent got the item.

Its a silly stalemate since if they return item to me they will get refund right away, but if they dont sent it back(im paying delivery) then they wont get paid.

So if it was sent back when I asked they would have the cash, silliness.

Pretty similar to me since what I sold was a PC and the case got bashed and psu damaged and both can be replaced for like £20 and new screws put into the parts that fell out and I have a spare mobo and graphics card in case either of them arent working.

I sent the guy another message saying as soon as he sends the item back he can have his refund instantly and i said the sooner he sends it back the sooner he has a refund and its upto him. his reply was

"Rather its up to you. A C.C.J. County Court Judgement will effect your credit rating. All future Job
applications and all Insurance and Mortage Applications. Not to mention large sums of money. The last resort would have been avoided. You have forced the issue, now live with it.You have till 1st November."

ok so am i going to end up paying huge amounts of money for this? really worried about all this and it is affecting me sleeping now :(

Let him take you to court. He would definitely lose and have to pay your costs too. Ebay rules clearly state he has to return item before a refund needs to be issued. Tell him this and say this will be your final communication on the matter.

you have done nothing wrong and he is just trying it on.

is it best to just send the money and be done with losing the item and the money as i dont think i can handle all of this :(

nope, I don't think he can give you a notice unless he gives you a clear obvious choice to refund (it isn't clear and isn't obvious as you don't know what will happen). No goods, no refund is probably my best argument.

How much was the goods?

it was for £52, not much i know but i just feel that if it goes to court am i going to get all sorts of fees on top.

ive offered to refund him once the item is returned but i feel bullied into sending it as i dont want the stress

Just call his bluff and tell him either he sends you the item back or you'll happily go and see him lose in court

You have ebay rules on your side here.
Assure him again then once he sends it back, you will send him the money.
You both have each others address, so I don't think much should go wrong.
Give him that m&s argument as well, if appropriate.
Also state that he will lose the court since a) it wasn't appropriate given time and choices
b) he attempted via verbal force which has no adequate time nor is it appropriate or the best choice for you as the seller

the thing is i just want it all sorting so ive said ill give him half back via paypal and once hes returned the item he can have the other half. i just really want it all sorted, my head is a mess and im so worried :(

mad-he is in the wrong and you have no need to be in a mess..how many people have told you the same thing?

tell him this is your last communication on this matter-as soon as the goods are returned you will refund. Failing that you will see him in court.
He is a joker so just do it...and then dont reply to him anymore!!!!!!!

Just utter rubbish - ccj for breach of contract = very minor, and you have done everything that is reasonable. If he sends back and it is faulty then give him a refund. If he sends back and it isnt then its up to him to pay postage to get the item back again (noone has the right to rescind for merely changing their mind unless using DSR when dealing with a business).

If he won't send back just state;
"No refunds can be made prior to inspection of the faulty item. If you do not send it back, no refund can be given. Please return the item via recorded delivery (or special if high value) and I will reimburse this cost if the item is found faulty upon inspection. If the item is not faulty you will be liable for the cost associated with returning it back to you, and no refund will be due. If you wish to go to court regarding this issue, please be aware that I will seek costs, and all prior correspondance will be entered into evidence. Have a nice day,

Doubt you'll hear from him again - CC wont look too kindly on threatening a seller for merely asking for an item to be returned prior to refund. As others have said you dont call up amazon regarding a purchase, expect an immediate refund and get to send it back at your leisure!

This guy is clearly trying to get something for nothing. DONT give into someone like this. I agree with above send him an email saying this is last communication on the matter or you will see him in court.

Dont worry about it, you have nothing to worry. You are in the right. It doesnt matter if the goods were faulty he still has to return them before getting a refund. If your still really worried about it I think you can get some free legal advice here. http://www.clsdirect.org.uk/

DONT SEND HIM A REFUND FIRST!!!!

He is trying it on big time, enough people have told you your be ok dont worry, you trusted the people on this site enough to ask for their advice, trust them once more and do as they say! x x x x
