Long story short, I purchased an electrical beauty item from Boots a week or so ago. I went to use it at the weekend and it will not work. I have charged it as per the instructions but it will not turn on, I don't actually think it is charging at all as there is no light to indicate that it is.

I have been back to Boots today and they no longer stock this item so will only offer me a refund. I still want the item but obviously I want a working one. Boots have advised me to contact the manufacturers.

My question is, I have not registered the warranty for the item yet as if the manufacturers aren't willing to replace the faulty item, it will just be going back to Boots for a refund.

If I inform the manufacturers of the problem before I register the warranty, can they refuse to do anything?

I just want to be sure before I speak to them!

of course they can refuse to do anything ,but phone and ask as they may try to repair it after all thats what they would do with it after boots sent it back to them.

unless it was a low value item in which case they norm wouldnt repair

How could they refuse to do anything? If the item is a week old and just out of the box and is faulty, surely they have to fix it / replace it.

The manufacturer's warranty is an optional extra and not a legal entitlement.

In order to make use of an optional warranty you must adhere to the manufacturer's terms.

Boots on the other hand are required, by law, to provide an item that is fit for purpose and of a reasonable built quality.

In the first six month since purchase Boots must proof that the product was in perfect working order when sold, if they can't do that they have to refund/replace/repair the item. After 6 month it is the buyer that must proof the product never worked properly.

Thank you forum police.

As I was saying before, I have now received a response from the manufacturers head office confirming I should have been offered a replacement under the warranty.

I was told a load of rubbish basically and they are launching an investigation to find out who told me that the warranty would not cover the device as it was not purchased from the manufacturers directly.

Yeap, not entirely sure why but I guess they aren't happy with some muppet giving out incorrect information.

Should be interesting to find out what they have to say.

You do know that the manufacturers warranty and your rights under the SOGA, which are legally binding are two different things right?

I'd clarify that with CS before you go into Boots making an idiot of yourself. If they don't have a replacemnt they don't have one.


But I am not going through Boots. I realise if they don't have one they can't replace it, I never said I thought that.

The manufacturers can sort it out now.

I posted the thread just before the I received the response.

My original question was can they refuse to honour the warranty, the answer appears to be no they can't.

Like I said, I responded just before the email came in from the manufacturer.
