Hi guys... I bought a Sony mp3 player from Empiredirect about 5 months ago and am now having some problems with it. I've rung them and so far they've been extremely unhelpful saying I can't have a new one because they don't have any and I can't have a refund because I've had it more than 28 days...

They were supposed to ring me today to see if they could sort out a repair but didn't... I just want my money back because God knows how long they'll have it in repair for... am i really asking for too much?

You won't get your money back, it's not in their interest to do so.

Legally however THEY (not any manufacture) are responsible for a 12month warranty from the date of purchase, demand a repair or you will formally request for a Dft agent to be assigned to investigate this matter and (hopefully if you did) chase up your credit card for them to negate the original payment due to them reneging on their legal obligations.

Schizoboy is quite correct that the warrenty is with them.

When you ring, ask them how long they are going to take to repair and when are they going to collect. Spell out that you think they have been very unhelpful so far, which is why you have sought advice.

How much did it cost you?

about £110 and add a few quid on top for phone calls, even though i'm using a local number from saynoto0870... they can keep you hold for quite a while!

Be very careful with this shower. I attempted to buy some headphones froim them in May for my Grandad and in August I was still trying to get them to deliver them to the correct address. They couldnt seem to understand that my address could be different to his, and what was worse they kept calling me up and addressing me by my Grandads name. In the end I lost the plot with them, and went to bigpockets for some, which were delivered in 2 days, although by then Id missed Grandads birthday by some margain!

I am not sure what other proof they could give you? Polaroid of your MP3 player with that days newspaper?

I have never had a problem with the company, even after a faulty VCR. Although I did used to live near enough to pickup from the wharehouse.
