You'll get it back. But do demand that they pay you some compo for the stress/hassle/expense/time this had caused you. Go for a free video camera and take it from thre. Good luck.

The bloke on the phone seems helpful but the idea that they could 'lose' my order but still take the money is a bit scary.

I've faxed a statement showing the order and been told they will contact their bank on Monday then 'proceed from there'.

if they don't sort it quickly let your credit card company know that you have never received the goods & they will get on the case.

Debit not Credit card.

Debit not Credit card.

Was it VISA debit?

this happened to me with jdwilliams for £300 and took near on 3 months to sort out

i wouldnt pay for anything over £100 without using a credit card - you get free protection from loss (handy in these days of dodgy sellers...)

One of the reasons i stopped shopping with Empire as they always take the money immediately and it is a pain to get it back.

The first and last time i bought online from Empire they had my money for 7 weeks before they received stock of my item, even though it said in stock on their site and took them a week to let me know it no longer was. Good luck.

Rang my Bank and they say the money was taken out by Empire on the day I ordered just as my statement says and no other transactions be it refunds or otherwise have been tracked from Empire.

They sent me an order number in an Email and the first person I spoke to on the phone after I realised something was wrong was a bit sharp and said no order was on the system in a way that suggested 'tough luck'. The second person I spoke to was much more helpful, so here is hoping they refund my money.

as said always use a credit card for purchases over £100 apart from the 1% or more cashback you'll get you also get extra protection from the credit card company.

obviously pay it off straight away or you'll be hit by the interest - if your worried about this bit you can always preload a credit card by putting the money on it before you make the purchase in effect making your credit card in credit in your favour then make your purchase.

anyway that doesn't help you so much this time I guess unless it was a visa debit card, good luck - worto.

It has the Visa symbol, what makes that different?

As far as I know visa debit cards are the only debit cards coverd by the same protection as normal credit cards, I don't have one but have heard this several times on here by people with them it might be worth starting a new thread to get some info on visa debit cards.

Might give you another option.

Just got a call from Empire to confirm some card details but the guy on the phone did not seem hopeful I would get my money back and suggested I would have to ask my bank.

This is a great kick in the balls to get a month before Christmas.

Trading standards.

I dislike companies who take money before goods are checked / orders are processed either.

Littlewoods took £40 from me and could only fulfill half the order - constantly updated with "it'll be dispatched next week" until finally I was automaticaly refunded. The missing item WAS on their site again to purchase - at about 5x the price I ordered it for.

Good luck getting your money back, don't give in and keep on at them as it's their duty to give it back. Demand compensation aswell.

Edit: You could also inform them you'll be posting on hotukdeals, because after reading your post I for one won't be touching empiredirect with a bargepole. :)

I have an order confirmation email.

I have a bank statement showing the money being taken.

I would have thought this would have been proof enough that they owe me £146. I'm starting to get angry now as this was a christmas gift for my Dad and i'll have to spend another £150 and hope that I eventually get my money back.

Within the last thirty seconds i've received a phonecall saying that they have found the transaction and will refund my money within the next three days (i'll believe it when i see it).

Frankly I think this is down to the bloke on the phone as the first customer service guy basically told me to get bent. I wouldn't touch them from now on but the person who handled my problem has my gratitude for keeping me up to date (as long as they actually give me my money back).

the reason for using a credit card, is the consumer credit act, which says that the card-issuing company (i.e. the bank) is equally liable if the goods are faulty/do not arrive. I have used this a couple of times where the seller has defaulted or refused to accept my complaint.

Got the money back this morning.

Phew

Putting EmpireDirect on my list of places to avoid as I've never had anywhere else simply lose my order while still taking the money. Bloke who handled my problem was pretty good though.

If it had of been definite I was getting my money back I would have liked to have seen what they would have given me for my trouble but as it was up in the air I didn't want to push it.
