I bought something off Ebay the other day, assuming it was brand new. When I received, the box was all beaten up and it had scratches on it

The seller put NEW in the drop down boxes on the listing, but foolishly didn't look too much at the description, and didn't notice that he had also added that it is a factory second.

Can a factory second be sold as NEW?

technically yes , second hand is only once it has been sold. Factory second is still new just imperfect

Yeah he can technicallly as it is a new product, not say a store return or whatever.

A factory 2nd is new, just didn't "make" the grade to cleared out a cheaper price, he put this in his listing, so I can never say this enough ALWAYS read the description thoroughly.

well - it's never been sold before.... technically it's new... but not mint!

If you're really that ****** off with it - just stick in a paypal claim - if you win - happy days, if you dont, you're stuck with it!

He won't win, it's as described, where does op say seller said mint? Just new which it is............

Well its not his fault then, so i probably shouldn't take action, maybe im best selling back on Ebay and cutting my losses.

If the goods inside are fine and it is not a gift where box condition may matter then best to remember to read carefully in future! However if goods damaged or was a gift then at least ask the seller if they would take it back - there may be a small charge but may be worth asking at least. Totally reliant on the good nature of the seller so ask nicely!
