Faulty jacket from shop - what are my rights?

Basically purchased a jacket for £175 on 24/5/09 and noticed when I got back in today after wearing the jacket that one button has fallen off and one on the shoulder is craked and no doubt will fall off.

I have only wore the jacket 3 times and wondered does the shop have to provide a repair/replacement or is it my word against theirs?

Anyone have any experience of taking an item of clothing back to a shop and trying to get a fix or a replacement

Unless the jacket shows clear signs of misuse they are required to repair/replace/refund.

In fact, because the jacket is less than 6month old, they have to proof that the jacket was not defective at the time of purchase.

Even if the jacket was older than 6month, buttons should not start falling of like that. A product has to be of satisfactory quality, which it clearly is not.

Was gutted especially only wearing the jacket 3 times within a 7 week period, will phone the shop before I go in as sometimes you get the odd assistant that doesnt want to help.

DO NOT phone them, they will find it easier to fob you off over the phone rather than face to face and it will give them time to spin some bull crap to tel you when you show up, oh sorry the manager is not in etc if they are that way inclined towards customers.

Was it a bigger chain you bought from or a smaller local independant store?

For £175 you think it would come with some spare buttons too.

as above,face to face but be polite being rude will get you nothing

Any reputable store will I would think refund you or replace the item, I would have thought you would have got spare buttons in the pocket or sometimes stitched on the inside of the jacket. I always have had spare buttons when i have purchased shirts or jackets have you checked?:thumbsup:

It was a Superdry Brad leather jacket from Cult so would expect for the price it would last a while

Checked the pockets and no spare buttons so maybe their was some with the jacket and someone could have lifted them from the shop?

the shop is under no obligation to replace the jacket if it is out of the 30 day money back guarantee! read your reciept, also shops are not obligated by law to return any products it is at their discretion

All the receipt says

" We are pleased to offer an exchange or credit note on unsuitable goods. We can only refund faulty goods accompanied by a valid proof of purchase"

Am sure it;s not that simple as goods must be fit for use and wearing a jacket 3 times in a 7 week period doesnt sound right to me thats why I asked and was pointed to a different answer above

shop exchanged jacket with no problems. Good service as some shops have awefull customer service like toys r ur and go out of their way to blame customers
